Approve Use Permit Application No. UP-92-28 with the Findings and Conditions of Approval <br /> given in the staff report. <br /> FINDINGS <br /> 1. The establishment, maintenance, and operation of the use does not conflict with the General Plan. <br /> Staff can make this Finding because the proposed live entertainment Is consistent <br /> with the Goals and Policies for the General Commercial designation of the General <br /> Plan. <br /> 2. Adequate utilities, access roads, sanitation, drainage, and other necessary facilities have been <br /> provided, and the proposed improvements are property related to the existing and proposed <br /> streets and highways. <br /> • Staff can make this Finding because the site has access by frontage on West Lane, <br /> public water Is provided by Cal Water,and drainage to West Lane Is approved by the <br /> Department of Public Works. Sewage disposal is by septic sytem, which meets the <br /> requirements of the Department of Public Health Services. <br /> 3. The property involved is of adequate size and shape to accommodate the proposed use and all <br /> yards, building coverage, setbacks, parking areas, and other requirements of this Title. <br /> • Staff can make this Finding because the site plan, along with the recommended <br /> Conditions of Approval, will ensure that all code requirements and other standards <br /> will be met. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety or welfare <br /> or be injurious to the property or improvements of adjacent properties. <br /> • Staff can make this Finding because the Initial Study prepared for this Item found no <br /> potentially significant environmental Impacts. <br /> PROJECT DESCRIPTION <br /> The applicant is requesting a Use Permit to permit live entertainment at an existing nightclub and bar. <br /> The applicant is proposing live bands, DJ's, male and female dance revues, and topless dancing. The <br /> proposed activities will take place in the existing 3,350-square-foot building. Hours of operation are from <br /> noon to 2:00 a.m. daily, and 12 employees will be on the heaviest shift. <br />
