CONDITIONS OF APPROVAL MS-01-3 Brown , Minor Subdivision Application No. MS-01-3 was approved by the San Jo 'ui Couarch 17, 2001 unity Th s Development Department on March 7, 2001. The effective date of approval tentative map approval will expire on March 16,2004,which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified,and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact:Jim Van Buren,468-2374) a. PARCEL MAP:The Parcel Map shall conform to the Tentative Map dated January 17,2001. b. LOT WIDTH AND AREA:The following lot size and area regulations shall apply to this map: (1) Parcel 1 shall have a minimum lot width of 242 feet, measured at the front yard setback line. (Board of Supervisors'approval of Variance No.VR-00-2). (2) Parcel 1 shall have a minimum lot area of 1.8 acres.(Board of Supervisors'approval of Variance - No.VR-00-2). 2. BUILDING INSPECTION (Staff Contact:Kermit Darrow,209-468-3179 a. UNIFORM BUILDING CODE:The following Uniform Building Code and San Joaquin County Ordinance require mentswill be applicable and shall be incorporated in the construction plans before submittal to the Building Inspection Division. (1) Exteriorwalls less than 20-feet from the proposed property lines shall be of one-hour,fire- resistive construction. Openings shall be%-hour protected less than 20-feet to property line. 3. COUNTYCOUNSEL a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision,which action is brought within the time provided for in Section 66499.37 of the Government Code. 4.
