COUNTY OF CALAVERAS, <br /> STATE OF CALIFORNIA <br /> PLANNING COMMISSION <br /> August 7, 1997 <br /> RESOLUTION A RESOLUTION APPROVING A PARCEL MAP WAIVER FOR <br /> NO. 97-52 PETER OSPITAL <br /> WHEREAS, a request for a parcel map waiver was received from Peter Ospital for <br /> the division of 160 acres to two 80 acre parcels; and <br /> WHEREAS, the parcel is located in both Calaveras County and San Joaquin County <br /> and; <br /> WHEREAS, the applicant submitted a tentative parcel map pursuant to Section <br /> 16.01.150 of the County Code, and <br /> WHEREAS, the Planning Commission considered all of the information presented to <br /> it including the staff report, information presented at the public hearing orally and in writing; <br /> NOW THEREFORE, BE IT RESOLVED, that the Planning Commission approves <br /> the parcel map waiver based upon the following findings: <br /> 1 With the conditions of project approval, the parcels to be created must comply with <br /> requirements established by the Subdivision Map Act as to the area, improvement and <br /> design, floodwater drainage control, appropriate improved public roads, sanitary <br /> disposal facilities, water supply availability, and environmental protection. <br /> The larger portion of the property is located in San Joaquin County, 80%, which has <br /> already approved the parcel map waiver. <br /> BE IT FURTHER RESOLVED, that the Planning Commission approved the parcel <br /> map waiver with the following conditions: <br /> I To recognize the parcel split, a record of survey shall be recorded. <br /> 2. The record of survey shall depict and monument a 32' half road width west of the <br /> centerline of Ospital Road along the frontage of the parcel to be dedicated. <br /> 3. A 32' half width shall be dedicated to the public for public use along Ospital Road <br /> through the Public Works Department. <br />
