CONDITIONS OF APPROVAL <br /> MS-94-34 <br /> Benjamin Bechtold <br /> Unless otherwise specified, all Conditions of Approval shall be complied with prior to the approval <br /> of the Parcef Map. <br /> This approval will expire three years from the date of approval unless (1) all Conditions of Approval <br /> have been complied with and (2) a Parcel Map has been filed with and accepted by the Surveyor's <br /> Office. <br /> Those Conditions followed by a Section Number or other Statutory Requirement are based on <br /> Ordinance requirements. Ordinance requirements cannot be modified. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. Either a Second Unit Dwelling application shall be approved prior to approval of the <br /> Parcel Map, or one of the two residences on Parcel 1 shall be converted to storage. <br /> b. Parcel 1 shall have a minimum width of 150 feet. (Development Title Section 9-610.4) <br /> C. Parcel 1 shall be between two net acres and five gross acres in size. (Development Title <br /> Section 9-610.3[a[) <br /> d. A note shall be placed on the Parcel Map, a Notice of Minor Subdivision Restriction shall <br /> be recorded concurrently with the Parcel Map to the effect that the homesite is restricted <br /> from transfer until September 17, 2004, and the property shown on the Parcel Map is <br /> restricted from further subdivision, for homesite purposes, by Section 9-610.3 of the San <br /> Joaquin County Ordinance. <br /> e. The following note shall be placed on the Parcel Map and also recorded as a separate <br /> instrument: <br /> In accordance with Section 9-610.3 of the San Joaquin County Development Title <br /> for the creation of homesite parcels, these parcels cannot be further subdivided. <br /> f. If, in the course of development, concentrations of prehistoric or historic-period materials <br /> are encountered, all work in the vicinity of the find shall halt until an archaeologist can <br /> evaluate the materials and make recommendations for further action. If human remains <br /> are encountered, all work shall halt in the vicinity, and the County Coroner shall be <br /> notified immediately. At the same time, a qualified archaeologist shall be contacted to <br /> evaluate the finds. If human burials are found to be of Native American origin, steps shall <br /> be taken pursuant to Appendix K of the California Environmental Quality Act. <br /> g.
