STATEMENT OF FACTS <br /> 1 . The CIWMB has authority to regulate and conduct enforcement <br /> actions regarding Waste Tire Haulers within the State of California under PRC <br /> Section 42950 et seq. and attendant regulations contained in Title 14 of the <br /> California Code of Regulations (CCR). <br /> 2. RODE MONTIJO, Operator of four tire stores in San Joaquin <br /> County d.b.a. EL CAMINO TIRE, is responsible for the generation and, <br /> transportation of waste or used tires by a person not holding a valid Waste Tire <br /> Hauler Registration from CIWMB. <br /> 3. On January 15, 2004, Robert McClellan a Local Enforcement Agent <br /> for the San Joaquin County Department of Environmental Health (County), <br /> conducted a routine inspection of EL CAMINO TIRE, 48 E. Charter Way in <br /> Stockton and issued violations for not using a registered waste tire hauler (14 <br /> CCR 18462 (a)) and for not completing and maintaining manifest forms (14 CCR <br /> 18462 (b)). A true and correct copy of the inspection report is attached hereto as <br /> "Exhibit 1." <br /> 4. On February 5, 2004 the County conducted a reinspection of the <br /> above facility and issued violations for failure to complete and maintain copies of <br /> manifests (14 CCR 18462) and for failure to obtain a TPID number (14 CCR <br /> 18459.1). A true and correct copy of the inspection report is attached hereto as <br /> "Exhibit 2." <br /> 5. On April 2, 2004, the County conducted an office hearing to discuss <br /> the violations and for RODE MONTIJO to show cause why further legal action <br /> against him should not be commenced. During the hearing Mr. MONTIJO <br /> agreed to haul less than 10 tires at a time or use a registered hauler. A true and <br /> correct copy of the Notice of Office Hearing is attached hereto as "Exhibit 3." <br /> 6. On July 12, 2004, Garrett Backus a Local Enforcement Agent with <br /> the County inspected the EL CAMINO TIRE facility at 400 E. Lodi Avenue in the <br />
