California Health&Safety Code <br /> §5411 No person shall discharge sewage or other waste,or the effluent of treated sewage or other waste in any manner which will result in contamination,pollution,ora nuisance. <br /> §5411.5(a)Any person who,without regard to intent or negligence,causes or permits any sewage or other waste,or the effluent of treated sewage or other waste to be discharged in <br /> or on any waters o/the state,or discharged in or deposited where it is,or probably will be,discharged in or on any water of the state,as soon as that person has knowledge of the <br /> discharge,shall immediately notify the local health officer or the director of environmental health of the discharge.(b)Any person who fails to provide the notice required by this section <br /> is guilty of a misdemeanor and shall be punished by a fine of not less than five hundred dollars($500)nor more than one thousand dollars($1,000),or imprisonment for less than one <br /> year,or both fine and imprisonment. <br /> §5412 Whenever the local health officer finds that a contamination exists,the officer shall order the contamination abated. <br /> §115710 The Board of Supervisors shall order securely fenced,filled,or covered any abandoned mining shaft,pit,or other excavation on unoccupied land in the county whenever it <br /> appears to them,by proof submitted,that the excavation is dangerous or unsafe to man or beast. <br /> §115700(a)Every person owning land in fee simple or in possession thereof under lease or contract of sale who knowingly permits the existence on the premises of any abandoned pit, <br /> well,septic tank,cesspool,or other abandoned excavation dangerous to person legally on the premises,or to minors under the age of 12 years,who fails to cover,fill,or fence <br /> securely that dangerous abandoned excavation and keep it so protected,is guilty of a misdemeanor. <br /> §117555 A person who places,deposits,or dumps,or who causes to be placed,deposited,or dumped,or who causes or allows to overflow,sewage,sludge,cesspool or septic tank <br /> effluent,accumulation of human excreta,or solid waste,in or upon a street,alley,public highway,or road in common use or upon a public park or other public property other than <br /> property designated or set aside for that purpose by the governing board or body having charge of the property,or upon private property without the owner's consent is guilty of a <br /> misdemeanor. <br /> San Joaquin County Ordinance Code Title 9 <br /> §9-1110.3 Sanitation Permit Required.It shall be unlawful for any person to construct,add to,modify,or atter any vaulted privy,septic tank,wastewater disposal system,other pipe <br /> or conduit,or other means for the disposal,treatment,or discharge of wastewater without first securing a Sanitation Permit. <br /> §9-1110.4 Sanitation Permit Requirements.Sanitation Permits shall be subject to the following requirements:(a)Applications may be initiated by the owner or owner's agent and <br /> filed with the EHD.Applications shall include a site plan which clearly delineates the location and characteristics of the proposed use.(c)Permits approved shall be subject to those <br /> conditions which ensure that the proposed use meets the minimum requirements of the County including,but not limited to,the following means for the disposal,treatment,or <br /> discharge of wastewater:(1)Will not permit the escape of any unpleasant or noxious odors,vapors,or gases;(2)Will not permit the ingress and egress of flies,other insects,rodents, <br /> or animals;(3)Will not permit the discharge of wastewater or effluent from the wastewater disposal system to empty,flow,seep,drain,condense into,or otherwise pollute any <br /> watercourse,or other waters used or which may be used or suitable for use for domestic,recreational,or agricultural purposes;(4)Shall not be offensive,dangerous,or injurious to <br /> health,or create a nuisance;and(5)Shall conform in all respects to the regulations and standards of the EHD for the disposal,treatment,or discharge of sewage.(d)Work shall not be <br /> covered,concealed,or put into use until it has been inspected and approved by the EHD.(e)The Director of the EHD may order changes to any existing system,method,means, <br /> manner,or place for the disposal,treatment,or discharge of sewage in order that they shall not constitute a menace to the health of human beings or animals.The orders shall <br /> designate the pedod within which such changes are to be made.(f)The Director of EHD may approve Special Permits for limited periods of time. <br /> §9-1110.6 Prohibited Uses.The drilling,constructing,using,maintaining,or operating of the following uses are hereby declared to be public nuisances and are prohibited:(a)Sewer <br /> wells; b Pit dvies;and c Cesspools. <br /> §9-1110.7 Prohibited Discharges.Owners or those who maintain private on-site wastewater disposal facilities shall prohibit any of the following to flow or enter into a disposal system: <br /> (a)Automobile and Garage Waste.Waste water from automobile washing or garage floors;(b)Storm Drainage.Roof drainage or drainage waste resulting from natural runoff or <br /> irrigation;(c)Solvents and Toxics.Gasoline,cleaning solvents,paints,thinners,oils,or greases other than normal residential kitchen wastes;(d)Solids.Cloth,rope,metals,and solids <br /> of any kind;(e)Garbage.Garbage and similar waste material except when processed by approved garbage disposal units;(f)Kitchen Wastewater.Wastewater from any restaurant, <br /> bar,or other kitchen where food is prepared for public consumption unless first directed through an approved grease trap,as required by the Uniform Plumbing Code;(g)Air <br /> Conditioners.Waste drainage from water cooled refrigeration air conditioning;(h)Hazardous Wastes.Waste from hazardous materials;(i)Backwash.Backwash from water softeners, <br /> iron filters,and swimming pools;(j)Truck Terminal Wastes.Oil,grease,grit,and miscellaneous waste from operation of truck terminal,including washwater from trucks and garage <br /> floors. <br /> §9-1110.9 Compliance Required.It shall be unlawful to maintain or use any residence,place of business,or other building or place where persons reside,congregate,or are <br /> employed which is not provided with a means for the disposal of wastewater which complies with the requirements of this Chapter and the standards relating to wastewater disposal <br /> made and established by the Director of the Environmental Health Department. <br /> San Joaquin County Onsite Wastewater Disposal Standards <br /> Permit.§1.1.It is the responsibility of any and all persons performing any part of the repair or installation of a septic system to ascertain that a valid Sanitation Permit has been issued <br /> by the Director of Environmental Health prior to the initiation of any repair or installation.§7.2.All installations shall be installed as designed and approved.Any variation from approved <br /> design shall require a new sanitation permit and approval.§1.3.Sanitation permits shall be valid for one year from date of issuance.§1.6.Sanitation Permits shall be required for <br /> package treatment plant and subsequent disposal fields.§7.7.A separate Sanitation Permit may be required for the disposal system for each separate structure on the property.§1.9. <br /> A Sanitation Permit shall be required for repair of any part of the septic tank and/or leach field other than pumping of the septic tank. <br /> General Standards.§3.1.The location,installation and maintenance of the sewage disposal system and each part thereof shall be such that it will function in a sanitary manner and <br /> will not create a nuisance or endanger the safety of any water supply,ground water or surface water.§3.1.1.No part of any sewage system shall be located nearer than the approved <br /> distances from water supplies.§3.2.1.The sewage disposal system shall be designed to receive all domestic sewage from the property.No basement,footing or surface drainage or <br /> discharge from water softener,iron filters,pool filters or water treatment systems shall be permitted to enter any part of this system.§3.2.2.The sewage disposal system shall consist of <br /> a house sewer,a septic tank,distribution box,and a drainage system.§3.1.2.(c)The package sewage treatment plant system must be designed by a Registered Engineer qualified to <br /> do that work and must meet the discharge standards as set by the Central Valley Regional Water Quality Control Board for that particular treatment plant.§3.4 All abandoned septic <br /> tanks,or those to be abandoned,shall be filled with earth,sand or other approved material(UPC§722.2,722.3,722.4,722.5)§3.5.Temporary sewage disposal systems may be <br /> approved.§3.6.1 A minimum sewerage system repair shall equal the amount of leach line needed for an additional bedroom as deemed necessary by the Director. <br /> Septic Tank.§6.1 §6.1.2.All septic tanks shall be constructed of sound,durable concrete or other approved materials and shall be watertight,shall be installed level,and on a solid <br /> bed.Redwood septic tanks are not acceptable.§6.1.4.Septic tanks shall have a minimum of two compartments.§6.1.8.Design of septic tank shall be such as to assure uniform <br /> horizontal flow throughout its entire length.§6.1.9.Septic tank shall be 5 feet from property line and any foundation,structure,swimming pool or driveway,if watertight.§6.1.12.All <br /> unattached habitable structures on the same property shall have a separate septic sstem. <br /> Subsurface Disposal Field.§8.1.Location of the disposal field should be in an unobstructed area and shall meet the minimum approved distances.§8.2.Distribution box <br /> specifications.§8.3.Disposal trenches specifications.§8.4.Leaching lines specifications.§8.4.4.No leach line shall be placed under concrete,blacktop,roadway or structure. <br /> Barricades may be required to maintain unobstructed.§8.5.Filter material specifications.§8.6.Leach line and filter bed area calculations.§8.7.Filter bed specifications§8.8.Seepage <br /> itspecifications§8.8.2.The maximum depth of any pit shall be twenty five 25 feet§8.9.Mounded systems specifications.§8.10.Sums(greater than 8 feet in depth specifications). <br /> Vaulted Privies.§9.1.A vaulted privy is a temporary means of disposal.For other than temporary use,it will be permitted only in those areas where a subsurface disposal system is <br /> not practicable.§9.2.Location and distance specifications.§9.3.Construction
