Defendant, in the course of defendant's trucking busi- <br />ness is hereby permanently enjoined from: <br />a) Violation of Health and Safety Code §25189, §25189.2 <br />and/or §25189.5 by illegally disposing or causing the <br />illegal disposal of hazardous waste. <br />4. Defendant shall establish corporate procedures requiring <br />verification of contents of hazardous waste loads and spill con- <br />tainment in truck parking areas. <br />5. Defendant shall pay to plaintiff the sum of FIVE <br />THOUSAND DOLLARS ($5,000.00), for cost of emergency response, <br />investigation and oversight of clean-up operations incurred by <br />the Department of Health Services. Said payment shall be due and <br />payable to the Department of Health Services and shall be deli- <br />Ivered to the Office of the San Joaquin County District Attorney <br />in two payments, the first payment of $1,000.00 due January 1, <br />1988 and the second payment of $4,000.00 due February 1, 1988. <br />6. Defendant shall additionally pay to plaintiff the sum <br />of FIVE THOUSAND DOLLARS ($5,000.00). for cost of investigation <br />and suit incurred by the Office of the District Attorney of San <br />Joaquin County. Said payment shall be payable to the District <br />Attorney of San Joaquin County and delivered to that office in <br />two payments, the first payment of $3,000.00 due December 1, 1987 <br />and the second payment of $2,000.00 due January 1, 1988. <br />7.
