r WASTE DISCHARGE REQUIREMENTS ORDER NO. 5-00-031 -4- CITY OF LODI WHITE SLOUGH WATER POLLUTION CONTROL PLANT SAN JOAQUIN COUNTY concentrations in Dredger Cut are less than 5 mg/l. The Discharger is not capable of meeting these requirements with the current treaiment, storage and disposal facilities. 15. The U.S. Environmental Protection Agency (EPA) and the Board have classified this discharge as a major discharge. 16. The discharge is presently governed by Waste Discharge Requirements Order No. 93-030, adopted by the Board on 26 February 1993. 17. The permitted discharge is consistent with the antidegradation provisions of 40 CFR 131.12 and State Water Resources.Control Board (SWRCB) Resolution No. 68-16. Compliance with these requirements will result in the use of best practicable treatment or control of the discharge. The impact on existing water quality will be insignificant. 18. The SWRCB, on 16 May 1974, adopted Resolution No. 74-43 titled "Water Quality Control Policy for the Enclosed Bays and Estuaries of California". These requirements are consistent with the Policy. 19. The SWRCB Water Quality Control Plan.for Control of Temperatures in Coastal and Interstate Waters and Enclosed Bays and Estuaries of California (the Thermal Plan) is applicable to this discharge. For purposes of the Thermal Plan, the Discharge is considered to be an existing Discharger of elevated temperature waste. 20. Effluent limitations, and toxic and pretreatment effluent standards established pursuant to Sections 208(b), 301, 302,304, and 307 of the Clean Water Act (CWA) and amendments thereto are applicable to the discharge. 21. Information submitted by the Discharger in its "Water Quality Impact Report, White Slough Water Pollution Control Facility", dated October 1998, estimated the average dilution over a tidal cycle within Dredger Cut to be 2:1, and at the confluence with White Slough and Bishop Cut to be 4:1. The report indicates that effluent mixes and moves downstream predominantly in the north channel of White Slough. 22. The previous permit provided for a mixing zone for compliance with water quality objectives. The mixing zone extended throughout the entire length of Dredger Cut, approximately 1500 meters, to the confluence with Bishop Cut and White Slough. Order No. 93-030 established effluent limitations for compliance with dissolved oxygen and aquatic toxicity water quality objectives, and for disinfection to protect public health at the edge of this mixing zone. With regard to mixing zones, the Basin Plan states, "...the Regional Water Board may designate mixing zones within which water quality objectives will not apply provided the discharger has demonstrated to the satisfaction of the Regional Water Board that the mixing zone will not adversely impact beneficial uses...
