GROUND LEASE <br /> THIS LEASE, entered into this day of <br /> 1993, by and between the CITY OF LODI, a municipal con oration <br /> ("Landlord"), and NORTIERN CALIFORNIA POWER AGENCY ("Tenant"). <br /> 1. Premises. Landlord leases to Tenant and Tenant leases from <br /> Landlord that real property in the City of Lodi, County of San Joaquin, <br /> California, described in Exhibit A attached hereto and made a part hereof. <br /> The premises leased to Tenant are referred to in this Lease as the "Leased <br /> Premises" or the "Premises." <br /> 2 Use. Tenant shall have the use of the Leased premises for the <br /> purpose of the construction, operation and maintenance of a gas turbine <br /> power generation plant and incidental ancillary uses (the "Project"), and for <br /> any other lawful purpose. <br /> 3. Term; Extension. The term of this Lease shall commence on <br /> January 1, 1993 ("Commencement Date"), and shall terminate, unless earlier <br /> terminated in accordance with the provisions of this Lease, on a date fifty (50) <br /> years from the Commencement Date_ Tenant's right to exclusive possession <br /> shall commence on the Commencement Date. Tenant shall have the right to <br /> extend the term of this Lease on all the terms and conditions set forth herein <br /> for an additional period of fifty (50) years, to be exercised by written, notice to <br /> Landlord during the last year of the initial term of this Lease. <br /> 4. Rent. <br /> (A) Monthly Rent. Rent payments will begin on a monthly <br /> basis on the Commencement Date.
