Chambers <br /> Vice President <br /> Beck Development OCT 4 <br /> 3114 West Hammer Lane <br /> Stockton, CA ENVIRONMENTAL HEALTH <br /> PERMIT I SERVICES <br /> Dear Mr. Chambers: <br /> BECK DEVELOPMENT SITE, TRACY CALIFORNIA <br /> We have received the second draft of the Workplan describing the <br /> proposed activities for the characterization of the Beck <br /> Development Property in Tracy with a cover letter addressed to <br /> Alex Cunningham asking for clarification of issues of concern to <br /> you and Beck Development. The submitted workplan is being <br /> reviewed at this time and any comments concerning its scope will <br /> be transmitted to you in the near future. Mr. Cunningham has <br /> asked that I respond to the concerns expressed in your cover <br /> letter. <br /> We have consulted with the Property Evaluation Unit (PEU) and <br /> have agreed that Region 1 (formerly known as the Northern <br /> California Section) of the Department of Health Services (DHS) <br /> will be lead for the investigation activities under the DHS/Beck <br /> agreement and for any hazardous waste property determinations <br /> under Health and Safety Code (H&SC) Section 25220 et sea which <br /> may be made. Region 1 staff assigned to the Beck project will <br /> consult with the PEU as necessary. <br /> The Workplan guidelines and comments in the letters of March 24, <br /> 1988 and August 12 , 1988 provide all of DHS' comments regarding <br /> the characterization of contamination on the Beck property. Our <br /> staff is reviewing the second draft of the investigation Workplan <br /> to make sure that it addresses our comments in the letter of <br /> August 12 , 1988. <br /> DHS does not see a reason to make a hazardous waste property <br /> determination pursuant to H&SC Section 25220 et sec, provided the <br /> intent of the DHS/Beck agreement is completed. The intent of the <br /> agreement is that Beck Development will characterize the site <br /> with respect to hazardous wastes. The responsibilities of DHS <br /> according to the agreement are to provide an evaluation of any <br />
