Responsible Party <br /> Robert Kupka <br /> Lodi Airpark <br /> 23787 North Highway 99 <br /> Acampo, CA 95220 <br /> II. Summar <br /> The Department of Health Services (DHS) , Toxic Substances Control Division (TSCD) , <br /> discovered soil contamination at Lodi Airpark/Airport in January 1981. Since <br /> this date, the Department has sporadically tried to enforce clean-up. The soil <br /> was contaminated from mixing pesticides at the end of the runway and the crop- <br /> dusters washing down their planes on the asphalt. <br /> III. Violations <br /> Section 25189.5 Health and Safety Code: <br /> (a) The disposal of any hazardous or extremely hazardous waste, or <br /> the causing thereof, is prohibited when the disposal is at a facility <br /> which does not have a permit from the department issued pursuant to <br /> the provisions of this chapter, or at any point which is not authorized <br /> according to the previsions of this chapter. <br /> (b) Any person wno is convicted of knowingly disposing of any <br /> hazardous or extremely hazardous waste or who casuses any such waste <br /> to be disposed of at a facility which does not have a permit from the <br /> department issued pursuant to the provisions of this chapter, or at any <br /> point which is not authorized according to the provisions of this <br /> chapter shall upon conviction, be punished by a fine of not less than <br /> five thousand dollars ($5,000) or more than fifty thousand dollars <br /> ($50,000) for each day of violation, or by imprisonment in the county <br /> jail for not to exceed one year; or by both that fine and imprisonment. <br /> If the conviction is for a violation commited after the first conviction <br /> of the person under this section, the person shall be punished by <br /> imprisonment in the state prison for 16,20 or 24 months, or by imprison- <br /> ment in the county jail for not to exceed one year, or by a fine of not <br /> less than five thousand dollars ($5,000) or more than fifty thousand <br /> dollars ($50,000) per day of violation, or by both that fine and imprison- <br /> ment. <br />
