4 . 14 Extension Requests. If Respondents are unable to <br /> perform any activity or submit any document within the time <br /> required under this Order, Respondents may, prior to expiration of <br /> the time, request an extension of the time in writing. The <br /> extension request shall include a justification for the delay. <br /> All such requests shall be in advance of the date on which the <br /> activity or document is due. <br /> 4 . 15 Extension Approvals. If the Department determines <br /> that good cause exists for an extension it will grant the request <br /> and specify in writing a new schedule. Respondents shall comply <br /> with the new schedule. <br /> 4 . 16 Cost Recovery. In addition to liability for <br /> oversight costs, failure or refusal of Respondents to comply with <br /> this Order may make Respondents liable for any governmental costs <br /> incurred, including those payable from the Hazardous Substance <br /> Account or the Hazardous Substance Cleanup Fund for any response <br /> action at the Site, as provided in Section 25360 of the Health and <br /> Safety Code and other applicable provisions of law. Cost recovery <br /> may also be pursued by the Department under CERCLA. <br /> 4 . 17 Severability. The requirements of this Order are <br /> severable, and Respondents shall comply with each and every <br /> provision hereof notwithstanding the effectiveness of any other <br /> provision. <br /> 4 . 18 Modifications. Respondents may by written request <br /> seek modification, termination or revision of this Order or any <br /> portion of this Order or any program or plan submitted pursuant to <br /> -15- <br />
