Drawer "B" ,, <br /> Acampo, CA 95220 PERMIT% k- V���S <br /> Dear Mr. Kupka: <br /> POTENTIALLY RESPONSIBLE PARTIES AT LODI AIRPORT <br /> In response to your inquiry of June 11, 1990, the Department of <br /> Health Services, Toxic Substances Control Program (Department) <br /> has not assessed "blame" against any persons with regard to <br /> contamination at the Lodi Airport (site) . The Department is in <br /> the process of initiating an investigation into the extent of <br /> contamination at the site and any health risk the site may pose. <br /> As part of the initial investigation, the Department performed a <br /> preliminary search for potentially responsible parties with <br /> regard to contamination at the site. Robert E. Kupka and North <br /> Coast Helicopter Service, Inc. were named in the Remedial Action <br /> Order, docket #HSA 89/90-016, because the Department had <br /> information which showed these persons were responsible parties <br /> as defined by Health and Safety Code, section 25323 . 5 and <br /> 25385. 1 (8) . Other persons known by the Department to have <br /> operated at the site were investigated as potentially responsible <br /> parties; however, no information exists to indicate that those <br /> persons should be identified as responsible parties. <br /> On May 10, 1990, the Department received information submitted by <br /> Daryl Katcher on your behalf which contained a list of businesses <br /> and users of the airport and water loading/wash rack since 1977 . <br /> The Department was previously unaware that many of the businesses <br /> listed had ever operated at the site, and the list will be useful <br /> in the future identification of potentially responsible parties. <br /> In accordance with Health and Safety Code, section 25356. 1 (d) , <br /> the Department will allocate responsibility among all <br /> identifiable potentially responsible parties at the time a <br /> remedial action plan is prepared for the site. At this time, <br /> however, the Department does not have information which links any <br /> of the businesses listed to the contamination found at the site. <br />
