Kupka <br /> 239877 NorthE <br /> EHighway 99 F�f CTIVED <br /> Acampo, CA 95220 JUIN 8 1990 <br /> Dear Mr. Kupka: ENVIROr4MEWAL HEALTH <br /> NOTICE OF REMEDIAL ACTION ORDER FOR LODI AIRP( MIT/SERVICES <br /> The California Department of Health Services, Toxic Substances <br /> Control Division (Department) has determined that storage and/or <br /> handling of hazardous substances/materials at the Lodi Airport <br /> have resulted in the release of such substances/materials to the <br /> environment. Pursuant to California Health and Safety Code (HSC) <br /> Sections 25355. 5 (a) (1) (B) , the enclosed Order is issued to <br /> mitigate those conditions which represent an immediate threat to <br /> human health or the environment. Notwithstanding compliance with <br /> the terms of this Order, further actions may be required as <br /> necessary to protect public health, welfare, or the environment. <br /> The Department has determined that each of you is a responsible <br /> party (RP) with respect to hazardous substances/materials located <br /> at the Lodi Airport. As RPs you are directed pursuant to the <br /> enclosed Order to assume responsibility for the remedial <br /> activities identified. This Order sets forth a compliance <br /> schedule which begins on the effective date of the Order. The <br /> Department will oversee all phases of cleanup activities and may <br /> amend the Order at any time to require additional work or modify <br /> requirements for work previously ordered. All cleanup activity <br /> must be approved by the Department. <br /> Pursuant to Section 25347. 6 of the HSC, the State Board of <br /> Equalization (BOE) shall assess a fee upon each potentially <br /> responsible party for the administrative costs incurred by the <br /> Department in connection with the oversight of any removal or <br /> remedial action taken pursuant to HSC Section 25355. 5. Fees for <br /> the various phases of activity associated with abating the <br /> release or threatened release of hazardous substances are based <br /> on the relative size of each site as estimated by the Department. <br /> You may expect to receive a bill from the BOE assessing fees for <br /> Department oversight of removal or remedial activities necessary <br /> to comply with the enclosed Order. <br /> Failure to comply with the attached Order will result in the <br /> Department finding you in non-compliance with this Order. The <br /> Department would then proceed with activities detailed in the <br /> Order and seek cost recovery for these activities from RPs. <br /> Under cost recovery, RPs will be liable for all direct and <br />
