5. 9 . Compliance with Applicable Laws <br /> Respondents shall carry out this Order in compliance with all <br /> local, State, and federal requirements, including but not limited <br /> to requirements to obtain permits and to assure worker safety. <br /> 5. 10 . Endangerment During Implementation <br /> The Regional Administrator of Region 1 of the Department ' s Toxic <br /> Substances Control Program may determine that acts or <br /> circumstances (whether related or unrelated to this Order) may <br /> endanger human health, welfare or the environment and may order <br /> the Respondents to stop further implementation of this Order <br /> until the endangerment is abated. <br /> 5. 11. Site Access <br /> Respondents shall provide Department employees and other <br /> representatives with complete access to the facility at all <br /> reasonable times. The Department and its authorized <br /> representatives shall have the authority to enter and move freely <br /> about all property at the facility at all reasonable times for <br /> purposes including, but not limited to: inspecting records, <br /> operating logs, sampling and analytical data, and contracts <br /> relating to the facility; reviewing the progress of Respondents <br /> in carrying out the terms of this Order; conducting such tests <br /> as the Department may deem necessary; and verifying the data <br /> submitted to the Department by the Respondents. Nothing in this <br /> Order limits any access rights that the Department or other <br /> agencies may have pursuant to the law. <br /> 5. 12 . Liability <br /> Nothing in this Order shall constitute or be construed as a <br /> satisfaction or release from liability for any conditions or <br /> claims arising as a result of past, current, or future operations <br /> of the Respondents. Nothing in this Order is intended or shall <br /> be construed to limit the rights of any of the parties with <br /> respect to claims arising out of or relating to the deposit or <br /> disposal at any other location of substances removed from the <br /> facility. Nothing in this Order is intended or shall be <br /> construed to limit or preclude the Department from taking any <br /> action authorized by law to protect public health or safety or <br /> the environment and recovering the cost thereof. Notwithstanding <br /> compliance with the terms of this Order, Respondents may be <br /> required to take further actions as are necessary to protect <br /> public health, welfare or the environment. <br /> 5 . 13 . Government Liabilities <br /> The State of California shall not be liable for injuries or <br /> damages to persons or property resulting from acts or omissions <br /> by Respondents or related parties specified in paragraph 5. 20 in <br /> carrying out activities pursuant to this Order, nor shall the <br />
