Under Section 25358 . 1 of the <br /> California Health and Safety Code (H&SC) , any duly designated <br /> officer, employee, or representative of the State may require <br /> persons subject to Chapter 6. 8 of H&SC to furnish information <br /> necessary for the Department to determine the appropriate <br /> response to a release of hazardous substances or wastes. <br /> Therefore, the Department is requesting the information described <br /> in the Attachment to this letter pursuant to Chapter 6. 8 of the <br /> California H&SC. <br /> Compliance with the site specific request for information set <br /> forth in the Attachment is mandatory. Failure to respond fully <br /> and truthfully to this request within thirty (30) days of receipt <br /> of this letter, or to adequately justify such failure to respond, <br /> may result in enforcement action (enforcement action may include, <br /> but is not limited by civil penalties including fines of up to <br /> $25, 000 per day per violation) by the Department, pursuant to <br /> Chapter 6. 8 of the California H&SC, Sections 25358 . 1 and 25367 . <br />
