Analysis <br /> Back-ground <br /> This application has been returned to the Planning Commission at the request of the Board of-Supervisors. <br /> On August 3, 2017, the Planning Commission reviewed a previous draft of the proposed Text Amendment, <br /> and stated concerns regarding safety, incompatibility with non-industrial zones, and incompatibility with <br /> adjoining land uses, and therefore,determined the proposed Text Amendment application was inconsistent <br /> with the General Plan.The Planning Commission voted 4-1 to deny the application. <br /> The applicant appealed the Planning Commission's denial to the Board of Supervisors, and on September <br /> 27, 2017, the Board of Supervisors heard the Text Amendment application as denied by the Planning <br /> Commission. The Board stayed the appeal, directed Community Development staff to complete the <br /> environmental review, and directed the applicant to work with the Community Development Department on <br /> a revised Text Amendment application description. <br /> Staff met with the applicant on multiple occasions, however, no consensus was made, and the item was <br /> returned to the Board of Supervisors on June 5, 2018, where the Community Development Department <br /> recommended denial, as the concerns stated by the.Planning Commission had not yet been addressed. <br /> The Board of Supervisors voted to refer the revised text back to the P'lannh-g Commission for review. <br /> The applicant continued to work with the Community Development Department, and the draft for review <br /> tonight is the result of these continued meetings. <br /> Proposed Text <br /> The following analysis is of the new draft text,developed after direction from the Board of Supervisors.This <br /> text is essentially completely re-written, and contains many of the same elements with additional <br /> requirements added. <br /> The proposed Text Amendment application would amend the Fencing and Screening Chapter of the <br /> Development Title.(Chapter 9-1022),which provides development regulations regarding fencing throughout <br /> San Joaquin County. The proposed text includes a new Subsection relating specifically to Electrified <br /> fencing, to which the current Development Title text is mostly silent. The existing text will be discussed in <br /> detail below. <br /> The text in it entirety is contained contained in Attachment A of this Staff Report. In summary,the proposed <br /> Text Amendment application contains eight(8)components, which are listed below, <br /> 1. Definitions for "electrified security fence" and "protective barrier," which are two (2) terms used <br /> throughout the proposed text. <br /> 2. Expanding permitted zones for electrified fencing from only the industrial zones to all industrial, and <br /> agricultural zones, and some commercial zones. <br /> 3.
