Component 7 requires that all electrified fences are installed behind a protective barrier consisting of, at <br /> minimum, an open fence, and that the electrified fence is setback a minimum twelve (12) inches from the <br /> exterior fencing. If the protective barrier consists of fencing with open sections greater than three(3)inches <br /> in diameter, the setback is increased to three(3)feet. <br /> The requirements added in these components have mitigated for the previous concerns regarding safety <br /> and land use compatibility, and have allowed for the Community Development Department to recommend <br /> approval of the application. <br /> Existing Ordinance <br /> The Development Title permits electrified fencing in the industrial zones. The intent of the Fencing and <br /> Screening Chapter is to prescribe standards for fencing and screening to protect public security and safety, <br /> conserve and protect property, and improve the general appearance of San Joaquin County. As a result, <br /> Development Title Section 9-1022.3(e) provides restrictions on the placement of electrified fencing near <br /> residential areas stating"electrical fencing adjacent to planned or existing residential areas is prohibited." <br /> Therefore, electrified fencing is not permitted adjacent to parcels with a General Plan designation of <br /> residential, a zoning of residential, or that are developed with an existing residence. <br /> Currently the Development Title remains silent regarding electrified fencing in the commercial, agricultural, <br /> and residential zones. San Joaquin County Development Title is a permissive zoning document in which <br /> uses are prohibited unless they are expressly permitted through an ordinance. As a result, electrified <br /> fencing is not currently permitted in the agricultural, commercial zones, or residential zones. <br /> However, pursuant to Development Title Section 9-1022.6, the fencing requirements of the Development <br /> Title can be modified by the Director in cases where it is demonstrated that an alternative to said <br /> requirements would meet the intent of the Chapter. The applicant has previously submitted modification <br /> requests pursuant to-Development Title Section 9-1022.6. The Community Development Department has <br /> worked with the applicant on each request and reviewed-each request on a case-by-case basis to ensure <br /> that the intent of the Development Title has been met through each modification.As a result,the Community <br /> Development Department was able to approve many of these requests because the electrified fences were <br /> located in areas that were predominantly industrial. <br /> San Joaquin County PA-17000841Electric Guard Dog, LLC <br /> Community Development Page 5 <br />
