Analysis <br /> Background and History <br /> The existing project site is located east of Linden and situated in the northeastern portion of San Joaquin <br /> County along the Stanislaus County border. Access to the existing quarry operation is from Waverly Road, <br /> then easterly on an existing graveled road into the quarry mining-area. <br /> Land uses to the east, north, and west include agricultural grazing land and scattered rural residences, and <br /> to the south the County owned Foothill Landfill. Livestock grazing is the principal land use:klithin the project <br /> site vicinity. <br /> The original Excavation Permit EP-81-0009 was approved by the Board of Supervisors on May 6, 1982. <br /> The application was approved for the excavation of 712,000 cubic yards of dredge tailings and overburden <br /> located on APN: 093-450-01. <br /> On July 11, 1991, the Planning Commission approved the current Quarry Excavation Application No. QX- <br /> 91-0006 for-an expansion of EP-81-0009. The project approval included the excavation and reclamation of <br /> an additional 240 acres comprised of APN's 093-450-01 and 093-450-05. <br /> Due to changes in the economy and market conditions the applicant is requesting to extend the life of <br /> Quarry Excavation permit QX-91-0006 an additional 18 years for excavation and reclamation. If the <br /> Revisions of Approved Actions request is approved for the existing Quarry Excavation permit the new <br /> expiration date for the permit would be December 31, 2036. <br /> The project is vested under the previous approval of Excavation Permit EP-81-0009 and all mining activity <br /> has been subject to all applicable state Surface and Miring Reclamation (SMARA) Codes. The Community <br /> Development Department is able to recommend approval of the Revisions of Approved Actions application as <br /> all the findings can still be made in the affirmative. <br /> Opposition Letter <br /> The Community Development Department received a letter from the Quality Rural Life Association in <br /> opposition to the proposed request. The letter of opposition stated concerns regarding_traffic, air quality, <br /> and that earlier CEQA documents are inadequate: <br /> Traffic: The letter raised the concern of increased traffic. There will be no increase or change in tonnage <br /> as part of this request. There will be no increase in the existing truck trips already permitted with the existing <br /> approval. Existing conditions of approval require that applicant to maintain a Bond guarantee that if the <br /> permittee fails, refuses, or neglects to repair, under permit,any damages to Waverly Road which may result <br /> from the permittee's operations, the Department of Public Works may do to the work necessary to restore <br /> Waverly Road Equal to, or better than, its original condition by using the funds from said bond or cash <br /> deposit. <br /> Air Quality: The San Joaquin Valley Unified Air Pollution Control District reviewed the proposed operation <br /> and concluded project specific criteria pollutant emissions from the site would have no significant adverse <br /> impact on air quality. <br /> Environmental Determination:The Revisions of Approved Actions application request has been reviewed <br /> for compliance with the existing conditions of approval, rules and regulations of the Development Title and <br /> SMARA. The General Plan designation of the project site is A/G (General Agriculture), and the zoning is <br /> AG-160 (General Agriculture, 160-acre minimum). A Quarry operation may be conditionally permitted in <br /> the AG-160 zone with an approved Quarry Excavation Permit. <br /> San Joaquin County QX-91-0006\Garibaldi <br /> Community Development Page 3 <br />
