Recommendations <br /> Action <br /> Itis recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration; and <br /> 2. Approve the Revisions of Approved Actions for previously approved Quarry Excavation <br /> application No. QX-91-0006 with a new expiration date of December 31, 2036, revised Findings, <br /> Williamson Act Compatibility Principles, and previously approved Conditions of Approval <br /> contained in the Staff Report. <br /> Revised Findings <br /> 1. The proposal is for the removal of regionally significant or scarce deposits of mineral resources and not <br /> for the removal of prime farmland. <br /> • This finding can be made because the property is classified as MRZ-3 by the State of <br /> California Division of Mines and Geology. Areas classified as MRZ-3 contain aggregate <br /> deposits of mineral resources. The property is not prime farmland and the applicant has <br /> provided information indicating that the site has substantial mineral deposits. Topsoil and <br /> overburden will remain on-site and each phase will be reclaimed to grazing land as <br /> excavation proceeds. <br /> 2. The excavation will not have a detrimental effect on any surrounding agricultural land. <br /> • <br /> This finding can be made because the quarry operation is compatible with the surrounding <br /> agricultural uses. The area is sparsely populated and is used for cattle grazing. Quarry <br /> activities will not involve the release of any process water onto adjacent properties, nor will <br /> there be any blasting or use of hazardous materials in the extraction or processing operations. <br /> 3. The proposed rehabilitation of the property upon completion of the excavation will leave the property in a <br /> condition which will allow its reuse. <br /> • This finding can be made because the overburden and top soil is being saved, and after the <br /> sand and gravel is removed,the overburden and topsoil will be replaced,and the property will <br /> once again be used for grazing cattle. <br /> 4. Issuance of the permit shall not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements in the vicinity. <br /> • This finding can be made because the Environmental Initial Study prepared for QX-91-0006 <br /> found that the protect would be compatible with surrounding existing and future uses and the <br /> project would not result in a significant, adverse impact on the environment. Also, the <br /> conditions of approval require that the excavation be set back 25-feet from all property lines <br /> and the perimeter of the quarry site be landscaped with a row of trees or earthen berm to <br /> provide a visual buffer for the quarry site from roadways. <br /> San Joaquin County QX-91-0006\Garibaldi <br /> Community Development Page 5 <br />
