C_ <br /> 1 employee at Party City Facilities with violations,whose <br /> 2 responsibilities include hazardous-waste management, complete a <br /> 3 refresher course on compliance with California hazardous waste and <br /> 4 hazardous material law, and(2)deliver to every employee at all Party <br /> 5 City Facilities a notice reminding each employee how to properly <br /> 6 handle hazardous waste. <br /> 7 b. In the event an independent third-party audit finds seventy-five <br /> 8 percent(75%)or more of the Party City Facilities inspected during a <br /> 9 calendar year have one or more violations of Chapter 6.5 or Chapter <br /> 10 6.95 of Division 20 of the California Health and Safety Code, or the <br /> 1 I regulations promulgated under these chapters, Defendant shall, within <br /> 12 90 days of receiving notice of reaching this seventy-five percent <br /> 13 (75%) or more threshold level: (1)require that every employee at <br /> 14 Party City Facilities, whose responsibilities include hazardous-waste <br /> 15 management, complete a refresher course on compliance with <br /> 16 California hazardous waste and hazardous material law; (2) provide <br /> 17 the notices required in the above paragraph 4.4.b.2; and(3)deliver to <br /> 18 each regional manager and district manager a notice stating that <br /> 19 seventy-five percent(75%) of the Party City Facilities audited had <br /> 20 one or more violations of Chapter 6.5 or Chapter 6.95 of Division 20 <br /> 21 of the California Health and Safety Code, or the regulations <br /> 22 promulgated under those chapters. <br /> 23 4.4.d. By September 15 of each year, Defendant shall provide to the People's <br /> 24 representatives as set forth in Exhibit B, a complete list of all Halloween City Facilities in operation <br /> 25 for that calendar year.
