Unlawfully failing to segregate incompatible hazardous-waste items, in violation of <br /> 5 California Code of Regulations,title 22, section 66265.177; <br /> 6 4.3.n. Failing to comply with employee training obligations pertaining to the handling of <br /> 7 hazardous waste at its PC/HC Facilities, in violation of California Code of Regulations,title 22, <br /> 8 section 66262.34(d) and 40 C.F.R. section 262.16(b)(9)(iii), or California Code of Regulations, title <br /> 9 22, section 66265.16, whichever may apply; <br /> 10 4.3.o. Failing to properly manage,mark, and store universal waste at each of its PC/HC <br /> 11 Facilities, in violation of the standards for universal waste management found in California Code of <br /> 12 Regulations,title 22, sections 66273.33 through 66273.36; or in the alternative, failing to manage <br /> 13 such waste as hazardous waste, in violation of Chapter 6.5 and its implementing regulations in <br /> 14 California Code of Regulations,title 22, including,but not limited to, section 66262.34; <br /> 15 4.3.p. Failing to keep a record of each shipment of universal waste sent from any of its <br /> 16 PC/HC Facilities, in violation of California Code of Regulations,title 22, section 66273.39; or in the <br /> 17 alternative, failing to manage such waste as hazardous waste, in violation of Chapter 6.5 and its <br /> 18 implementing regulations in California Code of Regulations, title 22,including, but not limited to, <br /> 19 section 66262.34; <br /> 20 4.3.q. Failing to treat returned or discarded non-empty aerosol cans at its PC/HC Facilities <br /> 21 as universal waste or hazardous waste, in violation of California Code of Regulations,title 22, <br /> 22 section 66273.1 et seq.; <br /> 23 4.3.r. Failing to implement, maintain, or submit to the responsible CUPA, a complete <br /> 24 hazardous materials business plan for each of its PC/HC Facilities, in violation of Health and Safety <br /> 25 Code sections 25505, 25507, and 25508, and California Code of Regulations,title 19, section 2650; <br /> 26 4.3.s. Failing to implement, maintain, and comply with an employee-training program on <br /> 27 hazardous materials, in violation of Health and Safety Code section 25505(a)(4) and California Code <br /> 28 of Regulations,title 19, section 2659; <br /> -6- <br />
