January 5, 1998 <br /> Page 2 <br /> 3. A Certification of Financial Assurance for PBR and CA Operations <br /> (DTSC Form 1232). <br /> If you meet the conditions of Title 22, Cal. Code Regs., section 67450.13(d) [closure cost <br /> estimate does not exceed$10,000], or(e) [facility's PBR unit operated no more than 30 days in <br /> any calendar year], you are not required to submit financial documents, but only the DTSC Form <br /> 1232 and the closure cost estimate. The required form is enclosed for your convenience. <br /> If DTSC does not receive the appropriate documentation of your compliance within the <br /> specified time frame, you will be issued a Report of Violation. A Report of Violation is the first <br /> step in DTSC's formal enforcement process. Failure to comply with the financial assurance <br /> requirement could subject your facility to formal enforcement action with penalties up to $25,000 <br /> per day. <br /> If you have any questions regarding the financial assurance for closure requirements, <br /> their applicability to your treatment unit(s) or the content of this letter, please contact <br /> Mr.Nabil H.
