OBSERVATION: On the south side of the facility at the outside area, one hazardous waste tank contained enough used oil to reach 2 inches on a dip stick. The tank was missing the accumulation start date. According to Freddy Mancha,Site Manager,all of the used oil should had been picked up. REGULATION GUIDANCE: A generator of less than 1,000 kilograms of hazardous waste in any calendar month who accumulates hazardous waste onsite for 180 days or less,or 270 days or less if the generator transports the generator's own waste,or offers the generator's waste for transportation, over a distance of 200 miles or more,for offsite treatment,storage, or disposal, is not a storage facility if all of the following apply: (1)The quantity of hazardous waste accumulated onsite never exceeds 6,000 kilograms. (2)The generator complies with the requirements of 40 Code of Federal Regulations section 262.34(d), (e)and(f). (3)The generator does not hold acutely hazardous waste or extremely hazardous waste in an amount greater than one kilogram for more than 90 days. CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 180 days in compliance with Title 22 California Code of Regulations. Provide a corrective action statement and a copy of the disposal records to the San Joaquin County Environmental Health Department(EHD)within 30 days. This is a Class II violation. 704 CCR 66273.33(b)UW handler failed to properly manage universal waste lamps. OBSERVATION:The facility is managing universal waste(UW)lamps in a way that does not prevent a release of waste to the environment. In the east attic area,several used UW lamps were observed stacked on each other and not placed in a box. Several dozen used UW lamps were also sticking out of their box. REGULATION GUIDANCE: (b)Lamps(including M003 wastes that contain lamps).A universal waste handler shall manage lamps in a way that prevents releases of any universal waste or component of a universal waste to the environment,as follows: (1)A universal waste handler shall contain any lamp in a container or package that is structurally sound, adequate to prevent breakage, and compatible with the contents of the lamp.Such a container or package shall remain closed and shall lack evidence of leakage, spillage or damage that could cause leakage under reasonably foreseeable conditions. (2)A universal waste handler shall immediately clean up and place in a container any lamp that is broken and shall place in a container any lamp that shows evidence of leakage or damage that could cause the release of mercury or other hazardous constituents to the environment.Containers shall be closed, structurally sound, compatible with the contents of the lamps and shall lack evidence of leakage, spillage,or damage that could cause leakage or releases of mercury or other hazardous constituents to the environment under reasonably foreseeable conditions. (3)A universal waste handler may remove a lamp from a product or structure, provided the universal waste handler removes the lamp in a manner designed to prevent breakage. CORRECTIVE ACTION: Immediately place all UW lamps into closed, structurally sound containers with labeling: "universal waste-lamps". Provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days. This is a Class II violation.
