JUb <br /> County. <br /> WHEREAS, Eagal is in the process of applying with the County <br /> of San Joaquin for a Conditional Use Permit ("CUP" ) , and <br /> ancillary entitlements connected thereto, for a ski club to be <br /> known as the Eagal Lake Ski Club. The property owned by Eagal, <br /> upon which the ski club will be situated, is set forth on the <br /> attached Exhibit "C" . <br /> NOW, THEREMRE, it is mutually stipulated and agreed as <br /> follows: <br /> 1. That Eagal shall be responsible to maintain the access <br /> road easement, and in connection with the condition for <br /> maintenance to be determined by the County of San Joaquin in <br /> connection with the anticipated application of Eagal for a use <br /> permit for the Eagal Lake Ski Club. <br /> 2. That Eagal shall be required to maintain the access road <br /> easement as required by the County and at no cost to Owner. <br /> 3 . The herein obligations of Eagal shall be conditional <br /> upon the issuance of an acceptable CUP to Eagal by San Joaquin <br /> County and the construction of the Ski Club. <br /> 4 . In the event of a default by Eagal, or Eagal' s <br /> successors or assigns, the Owner is hereby authorized to cause <br /> said maintenance to be done and to charge the entire cost and <br /> expense to Eagal or Eagal's successors or assigns, including <br /> interest thereon at the maximum legal rate from the date of <br /> notice of said cost and expense until paid. <br /> 5 .
