4 RESOLUTION OF PARADISE JUiVC'IION RECL AAIA T10N DISTRICT <br /> No. 2095 <br /> GRAFI MG THE REQUEST OF JOHN EAGA.L TO APPLY FOR <br /> AN ENCROAC-HAIENT PERMIT IN AND ALONG TILE DISTRICT'S LEVEE <br /> wJE=_RE.A,S, John Eagal is a landowner within the geographical boundaries of Paradise <br /> Juummn Reclamation District;and, <br /> WliEREA.S, the property owned by John Eagal, (APIA: 239-140-03, 06, 12 West <br /> Lorenzen Road, in the unincoporared area east ofTracy)has an access point at the <br /> northeast end ofLorcnzen Road near the District designated station 120+00 which is <br /> currently a dirt roadway over the District's leve and, <br /> WHEREAS, Jobn Eagml tsps r.wAe application to the County of San Joativnn Community <br /> Development Depamnent fbr a Use Permit for purposes by developing the:property - <br /> hereinbefore described into a private water sld club(Use Pernut Application No. UP-93- <br /> 14) ; and, <br /> WHIrR NS, the aforementioned application has been conditionally approved by the <br /> County of Sam Joaquin Community Development Department; and, <br /> V,r'MU-AS, it is understood that the intent and design of this project must undergo the <br /> scrutiny of the State Reclamation Board and the Army Corps. of Engineers and it is <br /> further understood that the District docs not in anyway warranty,gums adopt, <br /> support, condone, acquiesce, reject, disapprove, condemn or otherwise present any <br /> position regarding the soundness and/or feam-bility of the project or its design,in short, <br /> the District maintains a neutral position as to the project; and, <br /> WHEREAS, it is necessary for John Eagal to acquire the approval of the District prior to <br /> presenting his application for an encroachment permit to the State Reclamation Board for <br /> purposes ofusiaag the aforementioned access point for access in conjunction with,the <br /> proposed private ski club; and, <br /> WIU REAS, the Distrid'is charged with the responsibility of operating and main ainicg <br /> the levee as a flood control structure and the proposed project of John Eagai does present <br /> some impacts to the District's responsibilities; and, <br /> WHEREAS, at a mc--ting of the Board ofDirectors held October 11, 2001,it was agreed, <br /> as part of the Board's authority, to submit a resolution indicating approval of John <br /> Eagal's intent to use the aforementionr d access point in conjunction with the Proposed <br /> private ski club in support of the intended application of John Feral to the State <br /> Reclamation Board for an encroachment permit conditioned upon eaurmerated items. <br /> NOW, THEREFORE, IT IS RESOLVED that the Paradise Junction Reclamation District <br /> Nlo_ 2095 approves, by and through its Board of Trustees, the request of John Eagal, <br /> Owner of property designated APN:2390-140-03 and 239-140-06 which is the subject of <br /> I <br />
