If it is decided to discharge winery process wastewater to land in the future , compliance with all CVRWQCB requirements must be met . This condition has not been met . It appears the winery has been utilizing a well installed in 1990 ( Permit 90 - 1502 ) for use as an irrigation well . Although the well was constructed with a 105 foot annular seal needed for a domestic water supply well , this well showed elevated levels of nitrate and Dibromochloropropane ( DBCP ) when sampled in 2006 and may not consistently meet potable water quality requirements or maximum contaminant levels for constituents of concern . The facility is considered a transient noncommunity water system as defined in Health and Safety Code , Section 116275 ( 0 ) , and the actions noted below must be initiated to comply with the permitting and operational requirements of the California Safe Drinking Water Act . This condition has not been met . A Small Public Water System preliminary technical report must be submitted to the California State Water Resources Control Board , Division of Drinking Water (Water Board ) immediately . The issuance of a permit to operate a small public water system by the local primacy agency ( EHD ) is prohibited without the concurrence of the Water Board .
