If it is decided to discharge winery process wastewater to land in the future , <br /> compliance with all CVRWQCB requirements must be met . This condition is satisfied . <br /> • Condition of Approval 3 . c . requires the construction of a water well under permit and <br /> inspection by the EHD prior to final occupancy . This condition has not been met . <br /> It appears the winery has been utilizing a well installed in 1990 ( Permit 90 - 1502 ) for use as <br /> an irrigation well . Although the well was constructed with a 105 foot annular seal needed for <br /> a domestic water supply well , this well showed elevated levels of nitrate and <br /> Dibromochloropropane ( DBCP ) when sampled in 2006 and may not consistently meet potable <br /> water quality requirements or maximum contaminant levels for constituents of concern . <br /> The facility is considered a transient noncommunity water system as defined in Health and <br /> Safety Code , Section 116275 ( 0 ) , and the actions noted below must be initiated to comply with <br /> the permitting and operational requirements of the California Safe Drinking Water Act . This <br /> condition has not been met . <br /> A Small Public Water System preliminary technical report must be submitted to the California <br /> State Water Resources Control Board , Division of Drinking Water (Water Board ) immediately . <br /> The issuance of a permit to operate a small public water system by the local primacy agency <br /> ( EHD ) is prohibited without the concurrence of the Water Board . Please contact Michelle <br /> Frederick at the Water Board by email at michelle . frederick@waterboards . ca . gov or by phone <br /> at (707) 576 -2731 concerning the requirements for preliminary technical report submittal . <br /> At the time the Water Board determines that an onsite well can be used as the potable water <br /> source , a permit application to operate Small Public Water System shall be submitted to the <br /> EHD for approval . A yearly permit to operate a public water system is required . ( San Joaquin <br /> County Development Title , Section 9 - 1120 . 2 and 9 - 1115 . 9 . ) . <br /> The supplier must possess adequate financial , managerial , and technical capability to assure <br /> delivery of pure , wholesome , and potable drinking water in accordance with San Joaquin <br /> County Development Title , Sections 9 - 1120 . 2 and 9 - 1115 . 9 and C . C . R . , Title 22 , and Health <br /> and Safety Code , Sections 116525 and 116555 . <br /> Applicant may contact Robert McClellon , Program Coordinator , Small Public Water System <br /> Program , at (209 ) 468 - 0332 or rmcclellon@sjgov . org , for more information . <br /> • Condition of Approval 3 . d . requires the construction of the new OWTS under permit and <br /> inspection by EHD . This condition may be satisfied at any time up until final occupancy of the <br /> winery production facility . This condition has not been met . <br /> • Conditions of Approval 3 . f. and 3 . g . require the reporting of hazardous chemicals and wastes <br /> to the California Environmental Reporting System ( CERS ) at cers . calepa . ca . gov . Compliance <br /> with the laws and regulations for the programs listed below is required . This condition must <br /> be met before the storage or use of chemicals or wastes at the facility equal to or exceeding <br /> the amounts listed below .
