LODI AVE, LODI, CALIFORNIA Protection <br /> Dear Mr. Bois: <br /> The Department of Toxic Substances Control (DTSC) is in receipt of your letter <br /> dated July 17, 1997. I would like to correct a troubling error in the points you raised. In <br /> a letter dated March 13, 1997, DTSC stated that the Norge/Deluxe Dry Cleaners Site <br /> (Site) appears to have contributed to the perchloroethylene (PCE) contamination found in <br /> soils and additional soil gas and groundwater investigation would be required. <br /> Subsequently a meeting was held on March 27, 1997 with you, your client and your <br /> consultant, Montgomery Watson, regarding the sampling requirements. At the meeting <br /> you stated there was information your consultant could provide that would support your <br /> request for DTSC to retract our letter of March 13, 1997. DTSC, therefore, agreed to let <br /> your consultant submit that additional information for DTSC's review and evaluation. <br /> DTSC neither stated or implied that the additional information"would likely result in the <br /> issuance by DTSC of a"no further action" letter to ASPI and the Lewises." <br /> The negotiations for the Agreement between DTSC and the City of Lodi (City) <br /> were far-reaching and protracted. It was not possible to predict when, or even if, a final <br /> agreement would be reached. In fairness to your clients, DTSC continued to work with <br /> them and evaluate their submittals up to the time that the City assumed the lead. The <br /> alternative would have been for DTSC to have declined to meet with you or review your <br /> consultant's information.
