CONDITIONS OF APPROVAL <br /> MS-98-41 <br /> Oakpark Properties <br /> Minor Subdivision Application No. MS-98-41 was approved by the San Joaquin County Community <br /> Development Department on February 4, 1999. The effective date of approval is February 14, 1999. <br /> This tentative map approval will expire on February 13, 2002, which is three years from the effective <br /> date of approval,unless(1)all Conditions of Approval have been complied with and (2)a Parcel Map <br /> has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirementsmay apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jeff Fisher,468-9653) <br /> a. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall be between two (2) net acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> (2) Parcels 2, 3, 4, 5, and 6 shall have a minimum lot area of 40 acres. (Development <br /> Title Section 9-610.2) <br /> (3) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Table 9- <br /> 610.2) <br /> (4) Parcels 2, 3, 4, 5, and 6 shall have a minimum lot width of 330 feet. (Development <br /> Title Table 9-610.2) <br /> b. BUILDING PERMIT: The owner shall obtain a building permit for a single family dwelling for <br /> each homesite parcel concurrently with the approval of the parcel map. (Development Title <br /> Section 9-610.3[a][4]) <br /> C. ACCESS ROADS: Fire department access roads shall be in accordance with Section <br /> 902.2 of the California Fire Code and the standards adopted by the San Joaquin County Fire <br /> Chiefs Association. The existing 40-foot-wide road shall meet fire code requirements prior <br /> to the map being recorded. <br /> 2. DEPARTMENT OF PUBLIC WORKS (Seethe attached memo dated January 27, 1999.) <br /> 3. PUBLIC HEALTH SERVICES (Seethe attached memo dated January 27, 1999.) <br /> 4. COUNTY COUNSEL <br /> a. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, <br /> the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, <br /> officers,and employees from any claim,action,or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or annul an approval of the local <br /> agency, advisory agency, appeal board, or legislative body concerning a subdivision,which <br /> action is broughtwithin the time provided for in Section 66499.37 of the Government Code. <br />
