CONDITIONS OF APPROVAL <br /> QX-91-6 <br /> Ross Purviance <br /> Unless otherwise specified, all Conditions of Approval must be <br /> fulfilled prior to the establishment of the use and the issuance of <br /> any building permits. <br /> This approval will expire 18 months from the date of approval <br /> unless (1) all Conditions of Approval have been complied with, (2) <br /> all necessary building permits have been secured and remain in <br /> force, and (3) all necessary permits from other agencies have been <br /> secured and remain in force. <br /> 1. DEVELOPMENT SERVICES DIVISION: <br /> Conditions of Approval : <br /> a. This permit shall expire no later that 23 years from the <br /> date of approval. All proposed excavation and <br /> rehabilitation shall be completed prior to the expiration <br /> of this permit in accordance with the application and <br /> reclamation plan. <br /> b. Plant operations shall not be carried on during the hours <br /> from 9: 00 p.m. to 5: 00 a.m, except during periods of <br /> declared national, state, or county emergency (Section 9- <br /> 2244 (f) ) . <br /> C. A 100-foot setback is required from the natural swale and <br /> wetlands area. <br /> d. A 50-foot setback from the high water marks of the vernal <br /> pools shall be required. <br /> e. The maximum daily truck trips shall be 100. <br /> f. The plant and the open pit shall not be visible from <br /> Waverly Road. This shall be accomplished by berms and <br /> landscaping (Section 9-2244 (0) ) . <br /> g. No stockpiled soil or material shall be placed closer <br /> than 25 feet to a property boundary (Section 9-2244 (b) ) . <br /> h. All private roads shall be maintained to control the <br /> creation of dust. <br /> i. Any night lighting established on the property shall be <br /> arranged and controlled to not illuminate public rights- <br /> of-way or adjacent properties (Section 9-2244 (g) ) . <br /> Conditions of Approval - 1 - (QX-91-6) <br />
