Debra Lewis -2- <br /> QX-91-6 <br /> further provides that, unless an Interim Management Plan is submitted to <br /> the lead agency, a surface mining operation which remains "idle" for a <br /> period of a year or more shall be considered abandoned and the operation <br /> shall commence complete reclamation in accordance with the approved <br /> reclamation plan. <br /> If Ross Purviance intends to continue to operate the surface mining <br /> operation, he needs to submit a Interim Management Plan to the County. As <br /> I understand it, Terra, as the permit holder, will then need to assign its <br /> lease rights to Ross Purviance who would then be responsible for assuming <br /> the conditions of approval and providing adequate bonding to insure final <br /> reclamation of the site. Additionally, Mr. Purviance would need to provide <br /> a written work program for his proposal to continue the mining operation, <br /> including detailed excavation and reclamation plans. These are issues that <br /> Terra and Ross Purviance need to resolve. Without this concurrence, it is <br /> my understanding that Terra intends to proceed with reclamation plans to <br /> final closure as expeditiously as possible with the intent of receiving a <br /> "clean bill of health" and release from the financial security obligations. <br /> Once the site is reclaimed to final closure the existing quarry excavation <br /> permit will be terminated. Any further quarry excavation activities at the <br /> site would require a new permit. <br /> During my field review at the site, I also encountered an abandoned well <br /> that had been marked with red flagging. I have advised Doug Wilson of the <br /> Environmental Health Division of this situation for his department ' s review <br /> and disposition. <br /> This letter is intended to identify issues and provide the affected parties <br /> with information to determine how they wish to proceed.
