The 1320 ' setback <br /> line was established to minimize potential noise , dust , and <br /> visual impacts on the residence located just west of the exca- <br /> vation site . The applicant is requesting that the setback line <br /> be redefined as a 1320 ' radial line setback from the west prop- <br /> erty line . <br /> The applicant requests that Condition #4 be modified to allow <br /> the erection of processing equipment east of the 1320 ' setback <br /> line. <br /> Condition #23 requires a vegatative screen along the west pro- <br /> perty line. The applicant requests that this condition be <br /> eliminated. <br /> One other change proposed is that excavation be permitted to <br /> the depth of the hardpan. Under the existing permit , excava- <br /> tion may not go below an elevation of +270 ' mean sea level . <br /> The site plan submitted as part of the modification proposal <br /> identifies the typical hardpan elevation with a +280 ' <br /> elevation. <br /> The proposed modifications, except for Condition #23 , appear to <br /> be reasonable . Material to be excavated and sold will be <br /> limited to sand and gravel . Topsoil is to be replaced, and <br /> final grades are to slope less than five percent . The site <br /> will be suitable for agricultural uses upon completion of the <br /> project . All permit conditions not modified will remain in <br /> force . <br /> A Negative Declaration has been prepared for the application. <br /> FINDINGS <br /> A. The proposal is for the removal of scarce mineral resources <br /> and not for the removal of prime farmland: <br /> The only resource approved for excavation is sand and/or <br /> gravel . <br /> B. The excavation will not have a detrimental effect on any <br /> surrounding agricultural land: <br /> The excavation will enhance the agricultural suitability <br /> of the site and will not have an adverse effect on <br /> surrounding pasture lands. <br />
