Irey, Supervising Deputy District Attorney, for distribution pursuant to the terms of this <br />Final Judgment. <br />5.1 Civil Penalties <br />Defendant shall, within twenty-one (21) business days after entry of this Final Judgment, <br />pay NINE MILLION FOUR HUNDRED THOUSAND DOLLARS ($9,400,000.00) as civil <br />penalties pursuant to Health and Safety Code sections 25189 and 25514, and Business and <br />Professions Code section 17206, to the prosecuting agencies/regulatory agencies identified in, and <br />in accordance with the terms of, Exhibits B-1 and B-2, attached. <br />5.2 Supplemental Environmental Proiects <br />Defendant shall, within twenty-one (21) business days after entry of this Final Judgment, <br />pay ONE MILLION NINE HUNDRED SEVENTY FOUR THOUSAND DOLLARS <br />($1,974,000.00) for supplemental environmental projects identified in, and in accordance with the <br />terms of, Exhibit C, attached. <br />5.3 Hazardous Waste Minimization <br />Defendant will continue to designate four (4) full-time employees, or equivalent, two (2) <br />of whom are located in California, as responsible for environmental, health, regulatory and safety <br />compliance assurance in the State of California. It is recognized that these employees may also <br />have other responsibilities, including without limitation, environmental, health, regulatory, and <br />safety matters not related to hazardous waste. <br />Defendant shall also, for all Rite Aid Facilities (excluding those facilities listed in Exhibit <br />A-2): (a) utilize enhanced packaging procedures for returns processed through Defendant's <br />reverse logistics system, (b) continue ongoing implementation of Defendant's dumpster lock -bar <br />program, (c) review contents of returns to ensure proper use of Defendant's reverse logistics <br />system, (d) continue the use of electronic scanning devices to enhance Defendant's management <br />of damaged items at store level, and (e) implement program to convert certain Rite Aid Facilities <br />to long-lasting, energy efficient lighting aimed at reducing the frequency and volume of <br />replacement and disposal of discarded fluorescent bulbs. <br />STIPULATION FOR ENTRY OF FINAL JUDGMENT AND PERMANENT INJUNCTION <br />
