Venue <br />is proper before this Court pursuant to 28 U.S.C. §§ 1408 and 1409. This matter is a core <br />proceeding pursuant to 28 U.S.C. § 157(b)(2). The statutory predicate for the relief sought in this <br />Motion is §363(b) of title 11 of the United States Code (the "Bankruptcy Code"), as <br />complemented by Rule 6004 of the Federal Rules of Bankruptcy Procedure. <br />BACKGROUND OF THE CHAPTER 13 CASE <br />On February 16, 2015 (the "Petition Date"), the Debtor fled with this Court a voluntary <br />petition for relief under chapter 13 of the Bankruptcy Code. The debtor's plan has not been <br />confirmed. <br />THE PROPOSED SALE <br />MOHAMMAD AJMAL has agreed to purchase the debtor's interest in So. B Street. Mr. <br />Ajmal is the holder of the first deed of trust securing So. B Street. In consideration, Mr. Ajmal <br />will pay the above estate $14,000. In addition, the debt between Mr. Ajmal and the debtor will <br />be extinguished. Moreover, Mr. Ajmal will pay off all lien attached to So. B Street, thereby <br />relieving the debtor from paying those debt in her chapter 13 plan. Mr. Ajmal will pay all closing <br />costs and the above estate will not have to expend any funds in transferring its interest in So. B <br />Street to Mr. Ajmal. <br />Escrow will be handled by First American Title Company, 3203 West March Lane, Suite <br />110, Stockton, California 95219.
