MEW <br /> Previously, the City Permitting Department granted an <br /> encroachment permit for placing soil borings in the City right- <br /> of-way adjacent to the Valley Motors property. We would request <br /> at this time that a new encroachment permit be granted and that <br /> payment from the previous permit be applied. Valley Motors has <br /> engaged the firm of Wm. J. Hunter & Associates to perform the <br /> necessary vertical borings around the site of the removed tanks <br /> to allow complete profiling of any contamination that may be <br /> present. In addition, at your request, Valley Motors will <br /> provide the City of Stockton with a hold harmless agreement and a <br /> certificate of insurance naming the City of Stockton as an <br /> additional insured. This will be provided at the time that the <br /> encroachment permit is obtained and Wm. J. Hunter & Associates is <br /> ready to commence their work. <br /> At this time, it would be our intention to proceed with the <br /> work in a most expeditious manner as soon as the encroachment <br /> permit can be obtained. We estimate that upon commencement of <br /> work by Wm. J. Hunter & Associates the work will take <br /> approximately three weeks to complete. <br /> By way of final note, there seems to be some confusion as to <br /> whether or not there was a sidewalk at this site. During our <br /> telephone conversation, you indicated that you were going to <br /> review aerial photos and report to me with your findings. It is <br /> my client's position and recollection that there never has been a <br /> City curb, gutter and sidewalk at this site, therefore, restoring <br /> the site to its original condition would entail closing the hole <br /> in question and restoring the asphalt to its original nature. <br /> Please advise me at your convenience with respect to your <br /> findings. My office will follow up next week with regard to the <br /> encroachment permit in order that Hunter& Associates can begin <br /> their work.
