Main St CUF#: 12540 <br /> Stockton CA 95202 Global ID#: T0607700430 <br /> The San Joaquin County Environmental Health Department (EHD) has received a letter dated <br /> October 29, 2008, from your consultant, Upgradient Environmental Consultants (UEC) and has <br /> the following comments. <br /> In the letter, Mr. Victor Cherven stated that based on phone conversations with Mr. Mark Owens <br /> of the State Water Resources Control Board (SWRCB) Clean Up Fund (CUF) and Mr. James <br /> Munch of the Central Valley Regional Water Quality Control Board (CVRWQCB) you will not be <br /> submitting the Well Permit Application Form and fee due October 17 2008, as directed by the <br /> EHD in correspondence dated October 9, 2008, but will instead be submitting another work plan <br /> (revision) to Geotracker by November 15, 2008. <br /> The EHD is the lead agency for the oversight of the investigation and remediation at this <br /> underground storage tank (UST) site and is assigned the responsibility for requiring, reviewing, <br /> and evaluating work plans deemed adequate and necessary for this site. You are required to <br /> be incompliance with the EHD directives. By not submitting the Well Permit Application Form <br /> and fee by October 17, 2008 as directed by the EHD, you are not in compliance. <br /> The EHD has been in contact with Mr. Munch, who was disturbed by the letter since he had <br /> spoke with Mr. Clyde Hebbron of UEC, and the letter written by Mr. Cherven contained <br /> inaccurate statements about the discussion. Mr. Munch informed the EHD that he told Mr. <br /> Hebbron that the work plan approved by the EHD would provide valuable data and should be <br /> enacted. Mr. Munch also told the EHD that Mr. Hebbron was informed that the contamination at <br /> the site appeared stable but was at concentrations that required active remediation to reduce <br /> the concentrations. He also suggested that the UEC be prepared to run the test longer if the <br /> data gathered during the test shows remedial success. <br /> The EHD has also been in contact with Mr. Mark Owens of the CUF and was advised that <br /> whenever remediation costs will be incurred he recommended that pre-approval be submitted to <br /> the Fund. With the case of pilot studies, Mr. Owens noted that the Fund typically does not issue <br /> pre-approval unless the costs are expected to be considerable (test run for extended period of <br /> time, numerous wells, etc). Generally, if costs involved for a typical pilot study are reasonable, <br /> they are reimbursed if the work is required by, and approved by the EHD. <br />
