San Joaquin Valley Air Pollution Control District March 24, 1999 Kai Luoma pR 2, 91989 San Joaquin County Community Development Department �onlM6N Development Services Division 1810 East Hazelton Avenue Stockton, CA 95205 SUBJECT: MINOR SUBDIVISION TO CREATE A 5.6 ACRE LOT WITH A 60.01 ACRE REMAINDER (MS-99-03) Dear Mr. Luoma: The San Joaquin Valley Air Pollution Control District (District) has reviewed the above referenced project and offers the following comments: The San Joaquin Valley's air quality has been designated nonattainment by the EPA and by the Air Resources Board (ARB) for 03 (ozone) and PM-10 (fine particulate matter, dust). The Federal Clean Air Act (CAA) and the California Clean Air Act require areas that are designated nonattainment to reduce emissions until standards are met. Based on the information provided, it appears that this project will have a less-than- significant impact on the ambient air quality. Therefore, a negative declaration is appropriate from an air quality perspective. However, The construction phase of this project can generate emissions from the movement of soil, use of heavy equipment, bulk materials handling, asphalt paving and other related activities. As a result, this project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose of Regulation VIII is to reduce the amount of fine particulate matter (PM-10) entrained into the ambient air from man-made sources. The attached Synopsis highlights many of the requirements contained within Regulation VIII. The Synopsis is not meant to be all- inclusive, but it can be a useful compliance aid in the field and office alike. In addition, there will be cumulative impacts associated with the operation of this facility. As a result, District suggests that the project applicant take all feasible measures to reduce the amount of ozone precursors (reactive organic gases - ROG - and oxides of nitrogen - NOX ) that will result from the construction of this project or its continued operation. ❖ Planting of deciduous trees on the south and westerly facing sides of buildings.
