BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br /> STATE OF CALIFORNIA <br /> RESOLUTION <br /> R-20-136 <br /> RESOLUTION APPROVING THE APPEAL BY JO ANN HELEN VAN DYK TRUST <br /> (C/O MCKINLEY, CONGER, JOLLEY& GALARNEAU, LLP) OF THE PLANNING <br /> COMMISSION'S DENIAL OF VARIANCE APPLICATION NO. PA-1900247 <br /> OF JO ANN HELEN VAN DYK TRUST. <br /> WHEREAS, on January 16, 2020, the San Joaquin County Planning Commission denied <br /> Variance Application No. PA-1900247; and <br /> WHEREAS, on January 24, 2020,Brett S. Jolley of McKinley, Conger, Jolley, and <br /> Galarneau LLP appealed the Planning Commission's denial of Variance Application No. <br /> PA-1900247. <br /> WHEREAS, on July 21, 2020,the Board of Supervisors continued this matter to the <br /> August 4, 2020, Board of Supervisors hearing at the request of Brett S. Jolley of McKinley, <br /> Conger, Jolley, and Galarneau. <br /> WHEREAS, on August 4, 2020, the Board of Supervisors did conduct a public hearing <br /> on the Appeal,notice of which was given in accordance with the law, and oral and documentary <br /> evidence having been received in favor of or opposed to said Appeal, and this Board of <br /> Supervisors being advised on the matter. <br /> NOW,THEREFORE,BE IT RESOLVED by this Board of Supervisors that said Appeal <br /> be, and-is hereby approved of the Jo Ann Helen Van Dyk Trust, and that Variance Application <br /> No.PA-1900247 be approved based on the ability to make the required findings as provided for <br /> in"Attachment B". <br /> Resolution Template 07/2019 <br />
