Attachment B <br /> Alternative findings & Supplemental Information Submitted by the <br /> Applicant <br /> PROPOSED FINDINGS <br /> As required by Dev. Tit. §9-827.5 the following findings can be made in support <br /> of Mr. Van Dyk's application PA -1900247 <br /> 1. Special Circumstances. Because of the special circumstances applicable to <br /> the property, including size, shape, topography, location, or surroundings, <br /> the strict application of the regulation deprives the property of privileges <br /> enjoyed by other property in the vicinity and under identical zoning <br /> classification. <br /> • The variance would allow Mr. Van Dyk to continue residing on and <br /> farming the property witbout the burden of maintaining a second <br /> residence on the property. The intent and purpose of this variance <br /> request are in accord with County policies promoting continued <br /> family farming. <br /> • The property has already been developed with the residential uses. <br /> Mr. Van Dyk simply seeks the right to sell a portion of the developed <br /> property to alleviate his burden as landlord. Now that his parents <br /> have passed. <br /> • Although zoned AG-40, the area in the vicinity of the project site is <br /> populated with sub-40-acre parcels. For example, within a 2-mile <br /> radius there are± 88 parcels less than 5 acres in size. There are an <br /> additional± 32 parcels ranging in size from >5 to 10 acres in size. <br /> There are± 77 parcels ranging in size from >10 to 20 acres. Finally, <br /> there exist+ 71 parcels from >20 to <40 acres in size. In that same <br /> area, there exist only± 58 parcels that meet or exceed the 40-acre <br /> zoning size. <br />
