APPLIC&TION - VARIANCE SAN JOAQUIN COUNTY COMMUNIST DEVELOPMENT DEPARTMENT FINDINGS The following findings of fact must be made by the County before a Variance can be granted. Indicate what facts in the case of this application support each of the findings. These findings that you provide will be included with the Staff Reports that are distributed to members at the Planning Commission. 1. Because of the special circumstances applicable to the property, including size,shape, topography, location or surroundings, the strict application of the zoning regulations deprives the property of privileges enjoyed by other properties in the vicinity and under identical zoning classification. Property is situated approximately 500 feet from existing smaller parcels of land (Parcel numbers 342-180-15 , 16 , 17 , 18 ) . These smaller parcels clearly imply that actual land use lends to a "ranchette" atmosphere . These smaller parcels range in size from . 51 acres to 1 . 12 acres . Approval of this variance will provide the current owner the same privileges given to these smaller parcel owners . 2. The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which the property is situated. A t)r o v a l of this proiect will not create a special privilege as several other smaller parcels are within approximate) 500 feet of theproject ' s west boundary . Because this project does not request a zoning change , the creation of this parcel does not impact other property owners zoning , nor does it withdraw any current privileges given to these property owners . Project does not establish additional/new limitations on currentparcels - Parcel size is similar in size with existing surrounding 3. S single-family residence is a permitted use in the AG-40 zone , this proposed project will not create a use or activity which is not authorized .
