APPLIC&TION - VARIANCE <br /> SAN JOAQUIN COUNTY COMMUNIST DEVELOPMENT DEPARTMENT <br /> FINDINGS <br /> The following findings of fact must be made by the County before a Variance can be granted. Indicate what facts in the case of this application <br /> support each of the findings. These findings that you provide will be included with the Staff Reports that are distributed to members at the <br /> Planning Commission. <br /> 1. Because of the special circumstances applicable to the property, including size,shape, topography, location or surroundings, the <br /> strict application of the zoning regulations deprives the property of privileges enjoyed by other properties in the vicinity and under <br /> identical zoning classification. <br /> Property is situated approximately 500 feet from existing smaller parcels <br /> of land (Parcel numbers 342-180-15 , 16 , 17 , 18 ) . These smaller parcels <br /> clearly imply that actual land use lends to a "ranchette" atmosphere . <br /> These smaller parcels range in size from . 51 acres to 1 . 12 acres . Approval <br /> of this variance will provide the current owner the same privileges given <br /> to these smaller parcel owners . <br /> 2. The granting of the Variance will not constitute a grant of special privileges inconsistent with the limitations upon other properties in <br /> the vicinity and zone in which the property is situated. A t)r o v a l of this proiect will not create <br /> a special privilege as several other smaller parcels are within approximate) <br /> 500 feet of theproject ' s west boundary . Because this project does not <br /> request a zoning change , the creation of this parcel does not impact other <br /> property owners zoning , nor does it withdraw any current privileges given to <br /> these property owners . Project does not establish additional/new limitations <br /> on currentparcels - Parcel size is similar in size with existing surrounding <br /> 3. The Variance will not authorize a use or activity which is not otherwise expressly authorized by the zone regulation govArnine S <br /> parcel of property. <br /> ..Newly Psf-.ah1JshP(J parrels will be used for single—family residences . S <br /> single-family residence is a permitted use in the AG-40 zone , this proposed <br /> project will not create a use or activity which is not authorized . <br /> ONLY THE OWNER OF THE PROPERTY OR AN AUTHORIZED AGENT MAY FILE AN APPLICATION. <br /> 1, the Owner/Agent agree, to defend, indemnify,and hold harmless the County and its agents, officers and employees from any claim, action <br /> or proceeding against the Owner/Agent's project. <br /> 1, further, certify under penalty of perjury that I am(check one): <br /> OX Legal property owner(owner includes partner, trustee, trustor, or corporate officer)of the property(s)involved in this <br /> application, or <br /> O Legal agent(attach proof of the owner's consent to the application of the property's involved in this application and <br /> have been authorized to file on their behalf.,and that the foregoing application statements are true and correct. <br /> Print Name: Ross C .
