ILf`�-U <br /> 0 C T 8 2003 <br /> October 1, 2003 ENVIRONMENT HEALTH <br /> PERMIT/SERVICES <br /> Board of Supervisors <br /> Courthouse <br /> Stockton, CA 95202 <br /> Dear Board Members: <br /> REPORT ON VFW POST 1051 STATUS AND COMPLAINT ACTIVITY <br /> AS REQUIRED BY SITE APPROVAL APPLICATION PA-02-625 OF OLD GERMAN <br /> BAPTIST CHURCH (C/O VFW POST 1051) <br /> (FIFTH SUPERVISORIAL DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors accepts this report. <br /> BACKGROUND: <br /> On March 25, 2003, the Board of Supervisors denied the appeal of Janet Spkysma- <br /> Pilchard (C/O Ron Leachman) and upheld the Planning Commission's approval of Site <br /> Approval No. PA-02-625 to permit VFW Post 1051 to occupy an existing church building. <br /> As part of the approval the Board of Supervisors added Condition of Approval 1.p. that <br /> stated that the Community Development Department would prepare a report for the <br /> Board of Supervisors regarding PA-02-62.5, and present it to the Board of Supervisors at <br /> a publicly noticed hearing. <br /> REASON FOR RECOMMENDATION: <br /> The approval for Site Approval PA-02-625 is valid until September 23, 2004. Condition <br /> of Approval No. 1.a. states that the applicants are required to submit an Improvement <br /> Plan to the Community Development Department for review and approval. The <br /> Improvement Plan must indicate how all Conditions of Approval for the proposed project <br /> will be met. Pursuant to Development Title Section 9-818.4 all Conditions of Approval <br /> must be complied with prior to the initiation of the use. The Improvement Plan for the <br /> VFW Post has not yet been submitted. The Community Development Department has <br /> received one letter of complaint (Attachment A) in regards to VFW Post 1051 at 12455 <br /> E. West Ripon Road. The Enforcement Division made a site visit on August 20, 2003 <br /> and subsequently opened an enforcement case on the property for "outside storage of <br /> trash and junk". The VFW Post at that time was operating at the site without meeting the <br /> Conditions of Approval. The applicant has been contacted and informed that the VFW <br /> Post cannot operate without having completed the Conditions of Approval. The <br /> Enforcement Division has made subsequent visits to the site and has noted that the <br />
