Van Dyke <br /> Page 2 <br /> Since Senate Bill 1248 provides responsible parties the opportunity to enter into an <br /> agreement with PHS/EHD for evaluation of simple waste sites, that authority can <br /> now be used to issue "no further action" letters, to those sites that comply with our <br /> requirements. <br /> In a letter dated November 29, 1994, PHS/EHD provided you with the tests, <br /> methods, and preparations to be used for soil and groundwater sampling at the <br /> Souza site (copy enclosed). <br /> On March 9, 1995, a meeting was held at PHS/EHD and our agency was told that <br /> our comments concerning the Souza site were not desired. A PHS/EHD letter dated <br /> March 20, 1995, summarizing that meeting is enclosed. <br /> In a letter dated August 02, 1996, PHS/EHD requested payment for our services <br /> related to the environmental assessment. The services occurred between January <br /> and March 1995, were billed for several times, and no payment was made. The bill <br /> was finally paid in October 1996. <br /> On March 19, 1997, your office requested a meeting and it was explained that prior <br /> to meeting with you, water samples should be collected from the monitoring wells <br /> and analyzed for contaminants as outlined in our November 29, 1994 letter. Also a <br /> prepayment of $234 on your account to cover the cost of PHS/EHD time at the <br /> meeting was requested since payment of the previous bill was not done in a timely <br /> manner. <br /> Your May 8, 1997 letter requests a "no further action" letter from our agency. In <br /> order to evaluate the Souza property, the correct sampling described in the <br /> PHS/EHD letter dated November 29, 1994 must be performed under our inspection. <br /> Prior to any inspections, a minimum $234 fee for service must be paid. Once the <br /> sample results are reviewed by PHS/EHD, the proper notification to Department of <br /> Toxic Substances Control (DTSC) and CVRWQCB can be made as outlined in <br /> Senate Bill 1248, indicating that the Responsible Party and PHS/EHD intend to enter <br /> into a remedial action agreement.
