DEC-22-2004 16:26 PORT OF STOCKTON ANNEX 209 464 1251 P.02 <br /> • • <br /> ' £•�D •.s 200��043 <br /> Site Access Agreement <br /> 68,V7 <br /> THIS AGREEMENT("Agreement")is made and entered into by and between: <br /> THE STOCKTON PORT DISTRICT hereinafter referred to as "Owner", and Tyco <br /> Electronics Corporation, hereinafter referred to as Tyco. <br /> Recitals <br /> A. Tyco has previously]eased, operated, and/or otherwise used portions of a parcel of land, <br /> familiarly known as the Field Ave. site, located at 1848 and 1856 Field Avenue, <br /> Stockton, CA 95203, as well as the adjacent parcel identified as 133-390-20 on the tax <br /> records of San Joaquin County, California ("Owner's Property"). The Field Avenue <br /> parcels and the Owner's property are hereinafter collectively referred to as "the Site"). <br /> The Owners Property at various times has been used as a parking lot. <br /> B. The California Environmental Protection Agency, Department of Toxic Substances <br /> Control (DISC), as part of the facility closure process, in a Consent Agreement dated <br /> June 21, 2004 (Docket SRPD 03/04 SCC-4313) requested Tyco to conduct a Preliminary <br /> Endangerment Assessment (PEA) at the Site. Tyco and others will conduct soil and <br /> groundwater sampling, testing and other studies to assess the condition of the Site in <br /> conjunction with this request, <br /> C. Tyco has requested access to Owner's property for the purpose of conducting these <br /> environmental assessment activities, and Owner is willing to allow such access subject to <br /> the terms and conditions set forth in this Agreement. <br /> Agreement <br /> In consideration of the covenants and conditions set forth herein, as well as all other <br /> valuable consideration contained herein, the adequacy and sufficiency of which are hereby <br /> acknowledged by the parties, Owner hereby agrees to allow entry and access by Tyco, its <br /> contractors or subcontractors onto Owner's Property for the purposes mentioned above, subject <br /> to the terms and conditions set forth below: <br /> L Site Access <br /> 1.1 Grant of Access: Purpose <br /> Owner grants to Tyco, its respective employees, agents, contractors, <br /> subcontractors and authorized representatives,the right to test, repair, replace, and <br /> 1 <br /> DEC 22 2004 17:44 209 464 1251 PAGE.02 <br />
