1 <br /> removal and remedial activities for Respondents, and post <br /> 2 <br /> remedial sampling and monitoring procedures for air, soil , <br /> 3 <br /> surface water and groundwater. <br /> 4 <br /> 5 <br /> a. Upon Department approval of the RA Workplan and <br /> 6 schedule Respondents shall implement the final RAP as <br /> 7 <br /> approved in accordance with the approved RA workplan <br /> 8 and schedule. <br /> 9 <br /> b. Respondents shall be responsible for operation and <br /> 10 <br /> maintenance requirements in accordance with the final <br /> 11 <br /> RAP and RA Workplan. <br /> 12 C. During the implementation of the final RAP and RA <br /> 13 <br /> Workplan the Department may specify such additions, <br /> 14 modifications and revisions. to the RA Workplan as it <br /> 15 deems appropriate to implement the RAP. <br /> 16 d. Any remedial technology employed in implementation of <br /> 17 the final RAP shall be left in place and operated by <br /> 18 Respondents until the Department determines and states <br /> 19 <br /> in writing that Respondents may discontinue or modify <br /> 20 some or all of such remedial technology because <br /> 21 <br /> Respondents have met the criteria specified in the <br /> 22 final RAP for discontinuance of such technology or <br /> 23 <br /> because such modifications would better achieve the <br /> 24 goals of the final RAP. <br /> 25 5. 3 COST RECOVERY <br /> 26 5 . 3 . 1 Respondents shall be liable for all direct costs, <br /> 27 <br /> COURT PAPER _9 <br /> STATE OFCALIFORNIA <br /> STC. 113 REV. 8921 <br /> 85 3769 <br />
