The State Budget Act of 1987/88 <br /> requires the Department to actively "seek full reimbursement <br /> for projected expenses associated with monitoring hazardous <br /> waste mitigation projects operated under an agreement with <br /> responsible parties prior to initiation of such activities" . <br /> Enclosed is a memorandum which details our estimated costs for <br /> a one year period. <br /> I£ you as a responsible party wish to be considered cooperative <br /> with the Department's remediation activities at the LIKA-Field <br /> Avenue site, you will sign the Stipulation or negotiate with <br /> the Department and sign a modified Stipulation within 30 <br /> calendar days from issuance of this letter. If you do not <br /> stipulate to the Order, the Department will recover costs <br /> incurred through civil action by the State Attorney General in <br /> accordance with H&SC Section 25360. <br /> After 15 calendar days from the issuance of this letter, the <br /> Department will sign the attached Order and its requirements <br /> and schedule will be in effect. The Order sets forth various <br /> compliance dates. These dates are contingent upon the <br /> effective date of the Order and are as, follows: <br /> (1) within 10 days, submit the name of the project <br /> coordinator and the name and resume of the registered <br /> project engineer or geologist; <br /> (2) within 30 days submit the initial monthly report; <br /> (3) by 20 December all supplements to the Draft Remedial <br /> Action Plan will be submitted. <br /> If you do not comply with the requirements of the Order, the <br /> Department itself will proceed to investigate and remediate the <br /> site in accordance with H&SC Section 25355.5 and recover its <br /> costs from responsible parties in accordance with H&SC Section <br /> 25360. <br /> Because the Department has set forth and intends to enforce <br /> tight time schedules for the negotiation of the S'itpulation and <br /> initiation of the work described in the Order, we suggest that <br /> you immediately contact us to set a meeting date to discuss <br /> these issues.
