REVISED CONDITIONS OF APPROVAL (September 23, 1991) <br /> MS-91-102 <br /> PAGE TWO <br /> f. Dedication to result in a 4-942-foot wide right-of-way from the <br /> centerline of Micke Grove Road to the property line shall be <br /> required across the frontage of APN 059-140-15. <br /> g. The Water Supply Facilities Impact Mitigation Fee will be <br /> required for this development. The fee is due and payable at <br /> the time of the building permit application. (The fee <br /> currently is $1, 000. 00 per single family dwelling unit. The <br /> fee shall be automatically increased on January 1, of each <br /> year at the rate of 6. 9 percent. An additional 3 . 5 percent <br /> shall be added to the fee upon payment for processing and <br /> administering the program. <br /> 2. PUBLIC HEALTH SERVICES <br /> ORDINANCE REQUIREMENTS: <br /> The Ordinance Requirements listed below have been identified as <br /> pertinent to this project. Other Ordinance Requirements may also <br /> apply. Ordinance Requirements cannot be modified. <br /> a. A soil suitability study as required by Section 10100 of the <br /> San Joaquin County Development Code must be performed prior to <br /> recordation of the Parcel Map indicating that the area is <br /> suitable for septic tank usage. <br /> b. Construct an individual sewage disposal system on Parcel #2 <br /> under a permit and inspection by the Environmental Health <br /> Division at the time of development. <br /> C. Construction of an individual domestic water well on Parcel #2 <br /> under a well permit and inspection by the Environmental Health <br /> Division at the time of development. <br /> 3. COUNTY COUNSEL <br /> Conditions of Approval: <br /> a. Pursuant to Section 66474 . 9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or <br /> annul an approval of the local agency, advisory agency, appeal <br /> board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section <br /> 66499 . 37 of the Government Code. <br />
