(UP-94-8) Dear Mr. Larrouy: The San Joaquin Valley Unified Air Pollution Control District (SJVUAPCD) has reviewed the project referenced above and offers the following comments: San Joaquin Valley's air quality has been designated nonattainment by the EPA and the California Air Resources Board for the following pollutants, PM1, (fine particulate matter) and 03 (ozone). The California Clean Air Act (AB2595), requires areas that are designated nonattainment to reduce emissions 5% annually until standards are met. A Negative Declaration is appropriate for this project from an air quality perspective. However, a concerted effort should be made to reduce project emissions when construction occurs, as outlined below: The following rule has been adopted by the SJVUAPCD to reduce emissions throughout the San Joaquin Valley, and will apply to your project: • District Regulation VIII - Fugitive Dust Rules is a series of rules designed to reduce PM10 emissions generated by human activity, including but not limited to construction, road building, bulk materials storage and landfill operations. The SJVUAPCD suggests that the project applicant take all feasible measures to reduce the amount of dust (fine particulate matter-PM10) and ozone precursors (Reactive Organic Gases (ROG), and Oxides of Nitrogen (NO2, NO.) that will result from construction of this project.
