Initial Study <br /> considered to be nonrenewable resources. Because of their rarity, and the scientific <br /> information they can provide,fossils are considered highly significant records of ancient life. <br /> No known paleontological resources or unique geologic features exist within the project <br /> site.Therefore, the proposed project is not likely to destroy,either directly or indirectly, a <br /> unique paleontological resource or site,or geological feature.As described in Mitigation <br /> Measure CUL 1,if such a resource should be encountered during construction,work would <br /> stop until the resource can be evaluated and a determination made of its significance and <br /> need for recovery, avoidance,and/or mitigation.Therefore, the proposed project would <br /> result in a less than significant impact on paleontological resources or unique geologic <br /> features. <br /> d) Based upon a records search,no human remains are known to exist within the project site. <br /> The project site has historically been used for agriculture, which reduces the probability <br /> of undiscovered human remains. In the unlikely event that human remains are discovered, <br /> work within the area will be stopped and the San Joaquin County Coroner will be notified <br /> immediately. Work will only resume after the investigation and in accordance with any <br /> requirements and procedures imposed by the San Joaquin County Corner.In the event that <br /> the bone most likely represents a Native American interment,the Native American Heritage <br /> Commission will be notified so that the most likely descendents can be identified and <br /> appropriate treatment can be implemented.Therefore,with the incorporation of mitigation <br /> measures the proposed project would not result in any significant impacts with respect <br /> to disturbing any human remains, including those interred outside of formal cemeteries. <br /> To ensure a less than significant impact in the event of an accidental discovery,Mitigation <br /> Measure CUL-2, in conjunction with Mitigation Measure CUL-1,shall be implemented. <br /> Mitigation Measures <br /> Mitigation Measure CUL-1: Cease Work if Prehistoric,Historic or Paleontological <br /> Subsurface Cultural Resources are Discovered During Ground-Disturbing Activities. <br /> If cultural resources are encountered, all activity in the vicinity of the find shall cease until <br /> it can be evaluated by a qualified archaeologist. If the archaeologist determines that the <br /> resources may be significant, the archaeologist will notify the City and will develop an <br /> appropriate treatment plan for the resources. The archaeologist shall consult with Native <br /> American monitors or other appropriate Native American representatives in determining <br /> appropriate treatment for unearthed cultural resources if the resources are prehistoric or Native <br /> American in nature. <br /> In considering any suggested mitigation proposed by the archaeologist in order to mitigate <br /> impacts to cultural resources, the project proponent will determine whether avoidance <br /> is necessary and feasible in light of factors such as the nature of the find,project design, <br /> costs, and other considerations. If avoidance is infeasible, other appropriate measures <br /> (e.g., data recovery)will be instituted. Work may proceed on other parts of the project site <br /> while mitigation for cultural resources is being carried out. <br /> Mitigation Measure CUL-2: Halt Work if Human Skeletal Remains are Identified <br /> During Construction.If human skeletal remains are uncovered during project construction, <br /> the project proponent(depending upon the project component)will immediately halt work, <br /> contact the San Joaquin County coroner to evaluate the remains,and follow the procedures <br /> and protocols set forth in Section 15064.5 (e)(1)of the CEQA Guidelines. If the County <br /> coroner determines that the remains are Native American,the project proponent will contact <br /> the NAHC, in accordance with Health and Safety Code Section 7050.5,subdivision(c),and <br /> McHenry Avenue Road Widanina P Pct 31 ESA 1208599 <br /> In@al SWdy May 2009 <br />
