Land <br /> E, � Management <br /> Ray Weiss <br /> January 2009 <br /> Page 18 <br /> Native American Consultation <br /> Cultural resource identification inquiries also included a letter to the Native American Heritage Commission <br /> requesting a review of the sacred lands file in regards to the Planning Area and a list of Native American contacts <br /> within the region.The Commission's November 13,2008 response stated that a review of the sacred lands files <br /> failed to indicate the presence of Native American cultural resources in the immediate project area, but noted that <br /> the absence of specific site information within the sacred lands file does not indicate the absence of cultural resources <br /> within the project area.The NAHC response also included contacts who have requested information on projects <br /> such as this and who may have knowledge of cultural resources within the Planning Area.On November 21,2008, <br /> ESA sent letters to designated contacts with information about the proposed project and a request that they contact <br /> us if there were any questions or concerns(all NAHC correspondence can be located in Attachment A).To date, <br /> no further responses have been received. <br /> Thresholds of Significance <br /> In accordance with the thresholds for significance identified in CEQA Appendix G, the project would result in a <br /> significant impact on the environment if it would: <br /> a) Cause a substantial adverse change in the significance of a historical resource as defined in §15064.5; <br /> b) Cause a substantial adverse change in the significance of a unique archaeological resource pursuant to <br /> §15064.5; <br /> c) Directly or indirectly destroy a unique paleontological resource or site or unique geologic feature; <br /> d) Disturb any human remains, including those interred outside of formal cemeteries; <br /> Impact Discussion <br /> a) Results from the archival search as well as the field reconnaissance by ESA architectural historians identified <br /> two standing structures dating older than 50 years located within the proposed project area. Previous <br /> architectural surveys identified one structure(the residence at 1750 McHenry Avenue)as potentially eligible <br /> for listing in the NRHP under Criteria C (Attachment D). However, the reevaluation of this property <br /> by ESA determined that the residence fails to meet the criteria for listing in either the California Register <br /> or National Register of Historic Places,and is therefore not considered an historic resource in terms of CEQA. <br /> The property at 1303 First Street, as well as the olive tree in front of 2700 McHenry Avenue, were also <br /> determined ineligible for listing in either the National or California Registers,and are therefore not considered <br /> historic resources.As a result,demolition of the properties at 1303 First Street and 1750 McHenry Avenue, <br /> as well as the olive tree in front of 2700 McHenry Avenue,due to the proposed project would have a less- <br /> than-significant impact on historic resources. No mitigation is required. <br />
