Main St. <br /> Stockton, CA., 95202 <br /> On January 12, 1999, a meeting was held at San Joaquin County Public Health <br /> Services, Environmental Health Division (PHS-EHD) offices to discuss the illegally <br /> abandoned waste oil underground storage tank (UST) that was discovered in the City of <br /> Stockton sidewalk at the northwest corner of the above referenced site. This meeting <br /> was held to discuss why a UST Closure Plan and fees were not submitted as directed in <br /> PHS-EHD correspondence dated November 6, 1998 to Mr. O'Neill and Mr. Hyduke. <br /> PHS-EHD previously has directed the current landowner, Mr. Hyduke, to investigate the <br /> extent of petroleum contamination discovered after the two other UST's discovered in <br /> the City of Stockton sidewalk were removed in 1990. <br /> The meeting centered on establishing whom the responsible party is for this waste oil <br /> tank. Mr. Hyduke's representative, Mr. Frank Enright claimed that his client never knew <br /> of the waste oil UST, never operated the UST, and since it was still on City of Stockton <br /> property, the UST is the responsibility of the City. <br /> Mr. Ender, City of Stockton Public Works, attended the meeting to clear up unresolved <br /> encroachment issues from the two USTs removed in 1990. Mr. Ender was not present <br /> to establish the City's position on the UST ownership and requested Mr. Enright to have <br /> his client notify the City of his position. <br /> It was decided that Mr. Hyduke would notify the City of Stockton in writing with his <br /> concerns and copy PHS-EHD. In addition, PHS-EHD advised that this UST is out of <br /> compliance with California State UST Regulations and is currently listed as "illegally <br /> abandoned" and must be properly abandoned/removed. The last field inspection in <br /> March 1998 verified that a substantial amount of liquid with strong petroleum odors is <br /> still present in the UST. <br /> The responsible party(ies) for this UST is/are to be established as soon as possible. A <br /> permit for its proper destruction/removal issued by PHS-EHD is to be secured by the <br /> responsible party.
